Taking a loan from the bank to purchase a house

Q: I am from India. We are three bothers and we have only one home. With the grace of Allah (Ta'ala) coming year I will get married. So, I was thinking of buying a home. As I don't have enough money. I need to take a loan. But here in India we don't have Islamic banking. And I don't have other means to get that required amount. What is best for me? As there is Riba involved if I want to buy a flat from the banks which follow non-islamic banking.

Giving one's zakaat to a person who own less than nisaab

Q: A woman had some gold jewellery worth of giving zakat. She sold all her jewellery and started constructing a house for herself and her brother who also invested some percentage in the house and not even 50 percent is completed and she has ran out of money for house completion. Is she eligible for zakaat and can she utilize the money for construction?

Q: Ayk masla poochna tha zakaat ka k hum teen dost hain. Teen ne mil ke plot lia tha. So un logo ne muje payment kar di thi plot lene ke lie aaj se koi 6 month pehlay but still payment mere account main hai or plot walon ko transfer ni ki main ne jis main meri apni payment bi hai or zakat ka time aa gia hai.

1. Kiya ye plot wali payment jo accnt main pari hai iss par zakat ho gi?

2. Agr ho gi to on do larkon par b ho gi , bcz ono ne to apni taraf se payment mje kar di thi 6 month pehlay or on k lehaz se payment plot walon ko transfer ho gi? Mean ke dono larkon ne muje 3, 3 lakh de die or mere apnay bhi 3 lack hain. Total huy 9 jin main se main ne aagy plot walay ko 3 lac de die. So mere pass bachay 6 lac... account main or zkat ka time aa gia hai so ab mje batain k zkat ka hukam is par kese lagay ga?

mean kuch points hain 1- sirf mj pe lagay gi zkat ? 2-on dono par b lagay gi ?kio k wo to apni taraf se ada kar chukay hain... 3- or agr sirf mj pe lagay gi to kitni raqam pe lagay gi is 6 lac main.

Questions relating to the sale of a house

Q:

1. YYY wanted to sell his house(2003). He gave ZZZ(sister) three payment options viz a. Cash price – once off payment of full amount b. Terms price c. Rental Option

2. ZZZ chose the cash price option and paid a deposit

3. ZZZ then made a few minor payments.

4. ZZZ and her husband came to YYY house(2004), and said that they went to the bank for a loan but because of FICA documentation they were still in the process of finalising the loan. At this point, they asked YYY to consider if he will not let them pay off the balance at the amount the bank was going to charge them. YYY did not give an answer to this. How does this affect the transaction as the negotiation process was now put back on the table?

5. In 2006, YYY advised ZZZ that she hadn’t paid the full price as promised, hence YYY requested a renegotiation of the sale

6. Repeatedly over the course of time, YYY advised ZZZ not to continue depositing the money until the whole situation was settled and a shariah ruling was obtained

7. As the brother, YYY did not want to give his sister notice to vacate the house as he did not want her to be on the street

8. There was no consistency in any payments. Payments were made erratically.

9. ZZZ continued to deposit money into YYY account even when requested not to do so until the sale was clarified.

10. Despite being a cash sale, ZZZ paid the money over 10+ years at the cash price and now wants transfer of the house

Please advise on how YYY should proceed.

Q: In my will I have a home in which my wife and 1 son and 3 daughters live. If I am to have my assets distributed Islamically upon death - How is the value of the home distributed - is it sold to discharge the distribution - where will the wife and children live then?
