Q: I know that when a person performs tawaaf in umrah, then he makes istilaam of the Hajr-e-Aswad upon completion of his tawaaf (i.e. his eighth istilaam) as well as before proceeding for sa’ee (his ninth istilaam).
However, when a person is performing nafl tawaaf (not in the state of ihraam), then should he make the eighth istilaam upon the completion of the tawaaf, or can he just complete his tawaaf by merely passing the Hajr-e-Aswad without making istilaam?
A: It is sunnah for one to commence the tawaaf with making istilaam as well as to end the tawaaf with making istilaam. Hence, after completing the seventh round of tawaaf, one will make istilaam at the end of the tawaaf for the eighth time, regardless of whether one is in the state of ihraam (i.e. one is performing the tawaaf of umrah) or one is out of the state of ihraam (i.e. one is merely performing a nafl tawaaf).
And Allah Ta'ala (الله تعالى) knows best.
(وكلما مر بالحجر فعل ما ذكر) من الاستلام
قوله (وكلما مر) أي في الأشواط السبعة (قوله من الاستلام) فهو سنة بين كل شوطين كما في غاية البيان. وذكر في المحيط والولوالجية : أنه في الابتداء والانتهاء سنة ، وفيما بين ذلك أدب بحر ووفق في شرح اللباب بأنه في الطرفين آكد مما بينهما قال وكذا يسن بين الطواف والسعي (شامي 2/498)
ويختم الطواف بالإستلام يعني استلام الحجر (الهداية 1/242)
(قوله واستلم الحجر كلما مررت به إن استطعت) أي من غير إيذاء لحديث البخاري أنه عليه السلام طاف على بعير كلما أتى في الركن أشار بشيء في يده وكبر وفي المغرب استلم الحجر تناوله بيده أو بالقبلة أو مسحه بالكف من السلمة بفتح السين وكسر اللام وهي الحجر أفاد أن استلام الحجر بين كل شوطين سنة كما صرح به في غاية البيان وذكر في المحيط والولوالجي في فتاواه أن الاستلام في الابتداء والانتهاء سنة وفيما بين ذلك أدب (البحر الرائق 2/355)
واستلام الحجر في أوله وآخره وأما ما في بينهما فهو سنة مستحبة (غنية الناسك صـ 119)
