Q: When I was 13\14 I broke one fast on purpose knowing that it breaks my fast. Some years later I realised that I would have to keep 60 kaffarah fast. So I made them up. I kept 60 in a row everyday intending that it was kaffarah. My problem is I was thinking about this and I am certain that in one or two of the days I had to do ghusl and I remember water going down my throat. Will I have to make all my kaffarah fasts again?
A: If you are not sure whether water went down the throat, then you do not have to repeat the kaffara. If you are sure that water went down your throat whilst you were fasting, then at the time the water went down your throat, if you remembered you were fasting, then your fast will break and you will have to repeat the kaffara. If at that time you did not remember you were fasting, then your fast did not break and your kaffara will be valid.
