talaaq

Non-Muslim court divorce

Q: I have got a decree of dissolution of marriage from my husband through court, he did not appear in the court. Then the case forwarded to arbitration court, he did not appear there as well. Finally, the court issued me a certificate of divorce. As per his saying he did not receive a single notice from the arbitration court. But in response to his some query, I informed him that the case is in the arbitration court. Now, it has been five years, I did not remarry. Please advise whether my divorce has been confirmed or still I have a chance to go back to my husband.

Wife not hearing the talaaq

Q: I want to know that I gave talaaq to my wife once and then we revoked. After a year there was some problem again and I gave her Talaaq once. After about a week of second time, she started insisting with me that she did not listen that I gave her talaaq so it is not valid because she did not listen but I remember that I had told her talaaq one time. We want to know what Deen says in this case if husband say that he gave talaaq but wife says I did not hear? There was no other person at that time who can give testimony. Also, what Islam says that how we should proceed further as after revoking still there are fights and there is a chance that there may be talaaq again. I have asked my wife to sign a paper in front of Qur'an not to repeat those things which caused the fight because she did not want to bring any elder between us.

Husband saying 'ab to dedi' referring to talaaq

Q: Please help me, I am very worried. My husband was angry at me and just to scare me on messages he said "mai tumy talaq... Type kar doon aagy b" I replied I think hu gya and he said "chlo phir theek hai, ab sab chor dia maine.. hushhh.. tumy b america b". Later I told his sister and he called me and became angry that he didn't divorce me and while he was talking he said two or three times " chalo ab tu hu gaye na talaq" and I am not sure but I think he also said "ab to de di na talaq" just bcoz he was angry with me thinking that he did. Can you please tell if I am divorced or not. We both are very worried? What should we do now? Two days ago I had a dream we were having anal sex and I became worried when I woke up because I know it is haraam. Maybe that dream had to do with this.

Talaaq via email

Q: A week ago my wife and I were having a huge fight over email. With anger I emailed her the following but had no intention of even stating talaaq. Insha Allah you can provide me with the best explanation. “You said the only way you can have your life back is by me giving you your talaaqs then you got it”. Mufti this is what was said and I did not intend or mean it, I was really angry with previous messages I received from he. I would like your feedback as soon as possible.

Do these statements constitute talaaq

Q: I need some clarity as to whether the below statements are valid talaaq or not?

1. My husband asked me a question: "What will you do if I have to ask you for a divorce?"

2. When asked by my family if he wanted to leave me, he only nodded to confirm yes.

3. We signed a settlement agreement regarding the visitation rights of the children and maintenance. He now regrets everything and wants to reconcile.

Please advise if we can and the correct way to do so.

Showhar biwi ko gussay may kehna "Jao mene tumhain azad kia"

Q: Agar shohar biwi ko gussay may kahay "Jao mene tumahain azad kia" tum farig ho meri taraf se" and kai bar kahay eik sath. Aur time to time like eik month ke bad bhi yehi ilfaz kahay. Phir again kch arsay ke bad kahay tu kia isse talaaq ho jati hai? Ayk aur bat add karna chahun gi. Bad me agar khaawind kahay ke meri talaq denay ki niyat nai thi but usne hamesha gussay me kahay ye ilfaz. To kia ye talaq ho gayi?
