Inheritance

Q: Please advise on the following estate matter:

My uncle recently passed away, leaving behind 1 Wife, 1 Son and 2 Daughters. He did leave a will. What will the inheritors shares be respectively? His Son is confused/unsure about reconciling the estate, kindly advice on how he should deal with the estate and inheritance. [some family members have advised him not to give the sisters their full share]. His father left behind wealth [cash], properties[commercial, which are owned by companies, in which the son and wife are directors], residential property [marhooms residence], vehicles etc… He has just built a commercial complex worth millions [owned by a company, whose share-holders are wife and son], what will the shares of each inheritor be? Can he calculate the value of the building and pay out his sisters? Or will they have a share in the property? Will they get a portion of the rental received? Marhooms Zakaat, Salaahs, fasts etc were not upto-date, what will the kaffarah be in the case? Should he pay the heirs immediately? Or can he hold some of the inheritance? He has already started giving sadqaah [charity] out of the estate, is this correct? Kindly advice on any other aspects I may have left out.

Doubts regarding tahaarat

Q: If a person consumes something Haram and then touches the phone but I can't remember whether he did or not. I doubt the person did so whenever he touches the phone and touches things in house will everything be impure. Do I have to clean everything?

Washing off impurities

Q: While changing clothes if female normal discharge touches any part of the body like I just feel the wetness, can I clean that area with wet tissue paper and then with a dry one. I had wiped with a wet tissue so will my body be clean or am I impure and have spread impurity everywhere?

If someone drinks alcohol at night and then drinks water. The next day he doesn't gargle or brush and has tea water etc and then eats with his hands. If the hand touches the saliva will the hand be impure and if he touches anything with it will that be impure too or the water had cleaned the saliva of impurity. I'm being doubtful as someone visited home and did that.

Marital problems

Q: I am married for almost three years and its mostly been unpleasant. My husband verbally abuses me. He insults me, my family and late husband all the time. He also has a drinking issue. I have three kids from my previous marriage. I was a widow. I would like talaq as I cannot continue under these circumstances. I am financially independent and he does not do much for me or my kids. I would like to know how I should go about obtaining Talaaq as a female. These conditions are not healthy for my kids well being. I would also like to keep the house which he insists that I sell as he will not leave. Please advise.

Taking one's life due to mental illness

Q: I think there is a Hadith which speaks very harshly of people who take their lives - that they will go to jahannam and if am not mistaken no ghusl is done for them. But what about people who suffer from mental illness and this causes them to take their lives? Are they too viewed harshly in our Shariah? Jazakallah for taking the time to consider my question?

Renting out a flat to a woman experiencing marital problem

Q: What should a landlord do in a situation where a couple are having marital problems and the wife wants to rent a house from the landlord and live separately from the husband with the children. The couple are not divorced but the wife avers that she cannot take the husband’s constant abuse and beating anymore and living away from the husband will hopefully result in the husband “cooling down” and then there will be a basis for reconciliation.

Fishing

Q: I have some doubts regarding fishing, which I would like you to please clear.

1. Is permissible or haraam to fish without the intention of eating/selling/giving away the fish, that is the fisherman practise catch and release.

2. If the above is not permissible, would it be permissible for me to only take home the smaller fish, as I live alone and have no use for the larger fish.

3. If (1) and (2) are not permissible, what may I do with my fishing equipment. May it be sold or given away?
