Woman in haidh passing the meeqaat without ihraam

Q: I always knew that a person cannot pass the meeqaat without ihraam, even if it is a woman in the state of haidh. However, I was recently informed that since it is not possible for a woman in the state of haidh to enter ihraam, it will be permissible for her to pass the meeqaat without ihraam.

I was told that after her haidh terminates, she should take a bath and thereafter go to Musjid Aaishah to make the niyyah of entering into ihraam. At Musjid Aaishah, she should recite the talbiyah, and thereafter perform her umrah in Musjid-ul-Haraam. Is this correct?

A: This is incorrect. A woman in the state of haidh should enter into ihraam before passing the meeqaat. However, it is not permissible for her to perform her umrah, as it is not permissible for her to enter the musjid in the state of haidh and perform tawaaf in the state of haidh.

Hence, she should enter into ihraam before passing the meeqaat, and she will remain in ihraam until her haidh terminates. After her haidh terminates, she should make ghusl and thereafter enter Musjid-ul-Haraam to perform her umrah.

Since she is already in ihraam, she does not have to go to Musjid Aaishah to make the niyyah and recite the talbiyah before performing her umrah.

And Allah Ta'ala (الله تعالى) knows best.
