Q: How would you divide an estate where a man only has a wife and two daughters? The man had a mentally retarded brother who was never married and has already passed on. Will the grandson also inherit if his mother is still alive?

Q: We live in the sub Indian continent and we used live in a joint family. After my great grand fathers death my grandfather took care of the family and made wealth with little resource left from by his father.But when his brothers came to age they accused my grandfather of turning their fathers into into his own wealth.My grandfather gave them all the estates industries,shops,land etc which me made from the meager wealth.He also rebuild the few rooms house to 8 stories house so that his 8 brothers could live but his step mother told him to reside somewhere else as he was only child from the first wife.He had 8 brother and 4 sister all from that mother and My grandfather always considered them their own.After the distribution he bought a house in another place to reside there and made a new factory from the wealth acquired after distribution.He made his sons equal own of the factory as they had come to age.The 3 sons maintained the business and my grandfather took retirement.They gave him fixed rent,income or profit as u want to say.My father even told me that they took that amount as a fixed for the business even thou they lived in the joint family and and the family was run through profits of the business.He would just take the Very Important decisions. With Allah (SWT) blessings Our fathers made huge and took the profits and turn it into another factory with the grandfathers permission obviously. This time he said that the ownership would be given to the 3 sons and daughter in laws.My grandfather also had 2 daughters one married in a lavish way with gifts before withe money from the first factory.Another eloped with a man and united with the family after few years.They were later given plots as gifts by my grandfather.Our fathers with profits from the factory they made another house again with the fathers permission and was given the same condition.Both My grandmother and father lived with us in that house until their death. Both of them have share in the Factory and the first house.Now in their lifetime they said that the first house would be give to the daughters fully As the payment for the share in the factory and also because they have share in that.My grandmother expired then my grandfather expired May Allah (SWT) bless their soul. Our father without any disagreement agreed to give the whole property of the first house as few amount of their share and payment for the factory's share. Now I want to know that does this make the property of the sons haram to have and was there anything wrong with the inheritance.

Q: My father's brother passed away. This was regarding the partition and distribution of his property and cash. He has two daughters. One is married and the second the elder one is not married as she is mentally retarded. Now the family people are saying that the property is to be given to everyone including his brothers and sisters. As of now all his brothers and sisters are well settled and doing fine. Please help me out on this. His daughters are deserving candidates. Is it any way that they get what their father has left for them?

Is khawab mai unho ne mera chota beta aur bhai ka beta bhi dekha hai aik aur cheez jo ghar jal raha hai woh hum ne bech diya hoa hai yani ab woh humara ghar nahi hai. Q: My situation is as follows: I have one brother who is seven years younger than me. Just a little more about us. I am married with three kids all under 5 years old. He is two years married and intend moving in with my parents soon but they plan on renovating it into a double story because they want their space and privacy and they want the upstairs section to be completely separate from the rest of the house, separate entrance, no access from main house to the upstairs etc. I have had a bit of an issue with this because I feel my brother is doing this to benefit off my parents in terms of saving on costs like water electricity etc because if he was serious about taking 'care' of my parents, why does he want everything to be so completely separate from my parents? Why not just buy a separate house? He says he is going to pay for the renovating of that part of the house but knowing him, he will probably seek assistance from my father as well if he runs short. My dad has in the past been paying a lot of his expenses, all his wedding expenses, furniture for his current apartment, and recently last September when he and his wife went with my parents for hajj as well, my father paid for his haj as well. he qualified as a chartered accountant last year and is only recently been earning a CA salary. The 5 years before this he was doing his articles and earning very little. I don't think my dad is going to establish a will so if he doesn't, my question is, should my parents pass on one day before us, what happens to the house? Does my brother just inherit it all because he is going to be living in the house?

Q: My grandmother is dead and the entire estate is in my grandfathers grip. During my grandfathers life time he stated that after his death his two factories would be inherited by his 3 sons and out of the 2 houses one to the sons and one to 2 daughters. He even gifted them plots And always helped the children with money. Wasn't that unfair or unjust towards the daughters. And actually the sons earn from that business and live in that house. So, whats the masaail would it be ok if the daughters forgive my grandfather and their brothers.

Q: We have an issue of distributing land amongst our family. My Grand mother died. She had 4 daughters and 1 son. The son died before her death, So according to islam is their any distribution of land amongst the family of her deceased son or not. I mean how could the whole land be divided by 4 daughters and the children of the deceased son. Remember the son died before my grand mother death. thanks for your precious time and consideration.
