Muqtadis reciting Surah Faatihah in salaah

Q: In chapter no 7 (Surah Al-Araf) verse number 204 it is stated that "When the Qur'an is read, listen to it with attention, and hold your peace: that ye may receive Mercy". So why do people when praying Fajr, Maghrib and Isha (fardh) behind the imam (first 2 rakahs), when the imam finishes reciting surah AL-Fatiha, many people recite surah fatiha, although the imam is reciting another surah. Please do clarify this.

Giving a sheep in sadaqah

Q: Some days back I admitted my wife in a hospital because she was pregnant and doctors have confirmed that the child in her womb may have some defect and he may not survive longer. On hearing this news from the doctors, my mother decided to sacrifice a sheep in the path of Almighty Allah and distribute the meat to the neighbours so that Allah's blessings will be showered upon us. After the delivery, the infant was admitted in the hospital for 9 days and by the grace of Allah, the baby is recovering too fast and today we were discharged from the hospital. Now my mother is insisting to sacrifice the sheep and distribute it among our neighbours but I am trying to convince her that we should give the sheep or sell the sheep or pay its cost (cost of that sheep) to the masjid (mosque) which is under construction. Now I want to know what will be the better option, to sacrifice it and distribute it among the neighbours or to pay its cost to the masjid?

Dividends from a non-Shariah compliant investment

Q: A person has an investment in a unit trust from the 1970's. The unit trust was not shariah compliant, and thus included investments in alcohol/gambling based companies, interest based financial institutions, as well as ordinary companies.

1. Is it permissible to utilise dividends received from the unit trust to pay income tax for a business?

2. Is it permissible to offset these dividends received from the unit trust against income tax that is deducted from a persons salary by his employer? If this is permissible, can it be offset against amounts deducted for income tax in previous years (as the dividends were already received then, and tax deducted then), or would it only be permissible going forward (as dividends are received and income tax deducted)?

Sleeping on the floor

Q: A Hindu worker had come into my room. He then asked why I sleep on the floor despite having a normal bed. I was unsure how to explain, so I just replied that 'I find it more comfortable'. Was this the right thing to say? I sleep on the floor so that I can face the Qiblah whilst sleeping.

Tablighi Jamaat

Q: I have question regarding Tablighi Jamaat and their work, although it is not a time to ask this question as there is already some differences among them, but I am forced to ask this because as per an old proverb it is said that “Excess of everything is bad”.

I consider Tablighi Jamaat as a most influential Deeni work and consider it to be Haqq as our Ulema-i-Haqq does, do support them, I try to help them by any means whatever is possible. I consider the tasks of  Tablighi Jamaat a best way to spread the message of Allah Ta'ala, but in spite of above mentioned facts and Fazaail, it must clear to all of us what is its Status of Tablighi Jamaat  as per Islam/Shariyat.

Mufti Sahib for the sake of Allah Tala, kindly answer me the below questions and I am asking only for the sake of Allah Tala.

1. What is the Sharia Status of  Tablighi Jamaat (and its work),  is it Fardh, is it Waajib, is it Mustahab. (Kindly me the what is Ijma (إجماع) on this work)

2. If a person has a little free time and he has a choice to either go to attend Tablighi Aamaal or to help her wife and parents at home especially
when the kids are small, and he is not in a position to have a female servant or any helper who can help their family members. As per Shariyat Which one should he give preference? And for his own Islah he spare 1-2 Hours time in a week to attend his Sheikh’s Majlis.

3. What is the rule of a person or a group who consider Mustahab work equally as a Fardh, who insist or compel others to perform Mustahab work as are done for Fardh or Waajib.

4. Is there any Sharia rule,  that if a person comes near to Deen becomes religious with the help of some  Deeni Work  e.g Tablighi Jamaat, now is it compulsory for him as per Shariyat to do this work?

5. If a person has a time to attend Tablighi Jamaat and Tablighi Aamaal but still he does not attend either of Tablighi Aamaal, he consider it as one of the Islamic Work and tells I do not have Munasibat with this work, I do support it, but I will do the Deeni work by other means. Is he a Sinner as per Shariyat?
