Amaanat getting lost or stolen

Q: I just wanted to know if person A has any amaanat with him and person A is sincere in safeguarding that amaanat & yet that amaanat gets lost/robbed, what does the Shari'ah say under such circumstances ? Please mention the matter in detail.

A: If there was no negligence found from his side in safeguarding the amaanat, he will not be held responsible.

And Allah Ta'ala (الله تعالى) knows best.

( وهي أمانة ) هذا حكمها مع وجوب الحفظ والأداء عند الطلب واستحباب قبولها ( فلا تضمن بالهلاك ) إلا إذا كانت الوديعة بأجر أشباه معزيا للزيلعي ( مطلقا ) سواء أمكن التحرز أم لا هلك معها شيء أم لا لحديث الدارقطني ليس على المستودع غير المغل ضمان (الدر المختار5/663)

قال الشامي في رد الحتار: قوله ( غير المغل ) أي الخائن (رد الحتار 5/664)

( وإذا تعدى عليها فلبس ثوبها أو ركب دابتها أو أخذ بعضها ثم ) رد عينه إلى يده حتى ( زال التعدي زال ) ما يؤدي إلى ( الضمان ) إذا لم يكن من نيته العود إليه أشباه

قال الشامي في رد الحتار: قوله ( أشباه ) عبارتها أن المودع إذا تعدى ثم زال التعدي ومن نيته أن يعود إليه لا يزول التعدي ا هـ (رد الحتار 5/668)
