Q: I have already performed my fardh hajj and wish to perform hajj for my father who passed away and did not perform his fardh hajj. I will be performing hajj with my money, so I believe I can perform Tamattu Hajj also. Is this correct?
A: When performing Hajj-e-Badl on behalf of someone, the person performing Hajj-e-Badl should perform Ifraad Hajj or Qiraan Hajj.
As far as Tamattu Hajj is concerned, many Ulama, the likes of Hazrat Mulla Ali Qaari (rahimahullah), Hazrat Moulana Rasheed Ahmad Gangohi (rahimahullah), the author of Ghunyatun Naasik - Hazrat Moulana Hasan Shah Muhaajir Makki (rahimahullah), the author of Mu’allimul Hujjaaj - Hazrat Moulana Qaari Sa’eed Ahmad (rahimahullah), Hazrat Moulana Khaleel Ahmad Saharanpuri (rahimahullah), Hazrat Mufti Mahmood Gangohi (rahimahullah), have all issued the ruling that it is not permissible for the person performing Hajj-e-Badl to perform Tamattu Hajj, and if he performs Tamattu Hajj, the Hajj-e-Badl will not be valid.
The reason for the Hajj-e-Badl not being valid is that the one performing the Tamattu Hajj will pass the meeqaat with the ihraam of umrah and not the ihraam of hajj. He will only enter into the ihraam of hajj prior to the days of hajj, whereas the one performing Hajj-e-Badl should pass the meeqaat with the ihraam of hajj.
However, according to some Ulama, the likes of Hazrat Mufti Shafee Uthmaani (rahimahullah), Hazrat Mufti Rasheed Ahmad Ludhyaanwi (rahimahullah), the author of Lubaabul Manaasik - Hazrat Shaikh Rahmatullah Sindhi (rahimahullah), it is also permissible for the one performing Hajj-e-Badl to perform Tamattu Hajj, on condition that he seeks permission from the one on whose behalf he is performing Hajj-e-Badl.
In this case, the Damm-e-Shukr will be compulsory upon the one performing the Hajj-e-Badl and not upon the one on whose behalf the Hajj-e-Badl is being done. However, if the person on whose behalf the Hajj-e-Badl is being performed is pleased to pay for the Damm-e-Shukr, it will be permissible.

أما في المتمتع التمتع فلو أمره بالتمتع فتمتع عنه فالحج يقع عن المامور لا عن الآمر فأولى أن يكون الدم عليه (غنية الناسك صـ 184)
