Having relations with a slave after divorce
Q:
1. If a person has a slave as his wife and divorces her twice, can she remarry him after her master has relations with her or does she have to remarry?
2. If he was married to a free woman whom he divorced 3 times, thereafter she becomes a slave, can he purchase her and have relations with her prior to making halaalah?
A:
1. She will have to remarry and consummate the nikaah.
2. No, it is not permissible for him to have relations with her before halaalah.
And Allah Ta'ala (الله تعالى) knows best.
فإذا طلق زوجته الأمة ثنتين ثم بعد العدة وطئها مولاها لا يحلها للأول لأن المولى ليس بزوج
لو طلقها ثنتين وهي أمة ثم ملكها أو ثلاثا وهي حرة فارتدت ولحقت بدار الحرب ثم سبيت وملكها لا يحل له وطؤها بملك اليمين حتى يزوجها فيدخل بها الزوج ثم يطلقها كما في الفتح (رد المحتار 3/412)
