Investor and the working partner drawing a salary from the business

Q: I have a business question. Two people decided to open a business. One person invested the money and the other person is responsible for running the business and the profits are to be shared between them.

Does the invester receive a salary also every month according to the shariah?

A: Both the investor and the working partner will only be entitled to their shares of the profits which accrue from the business (in accordance to their shares in the business).

None of the two are entitled to receive a monthly salary. However, if any one or both mutually agree upon drawing a salary from the business, then upon the termination of the partnership, each partner should deduct the amount he took as salary from his share of the profits.

If any partner had taken extra profits (i.e. the amount he took as salary exceeded the amount that he was entitled to receive from his share of the profits), then he should return the extra amount he took to his partner.
