Q: Is the debt of expiation for breaking an oath considered a human right? If someone tries to pay their expiation debts but passes away without being able to do so, and this person is martyred, will our Allah forgive this person's expiation debts?
A: Martyrdom expiates all sins besides the sins that are from the category of debts.
Debts refers to all the rights of the servants. However, there are some rights of Allah Ta'ala which are also included in debts and are not forgiven through martyrdom e.g. outstanding salaah, zakaat, fasting, etc. Kafaarah enters under this right and debt of Allah Ta'ala that are not forgiven unless one makes taubah and fulfils the right.
And Allah Ta'ala (الله تعالى) knows best.
