Q: Is damm compulsory if a person clips his nails in the state of ihraam?
A: There are various situations in regard to this mas’alah and the ruling of each situation differs. Below are the Shar’ee rulings of the various situations:
1. If a person clips all the nails of his hands and feet in one gathering (one place), or he clips all the nails of his hands, or all the nails of his feet, or all the nails of one hand or all the nails of one foot, then in all these situations, only one damm (i.e. one sheep or goat) will be compulsory.
2. If he clips the nails of one hand in one gathering (one place) and the nails of the other hand in another gathering (another place), then two damms (i.e. two sheep or goats) will be compulsory.
3. If he clips less than five nails of one hand or of one foot, then for each nail he clips, sadaqah will be waajib.
4. If five nails are not clipped from one hand or one foot, but the total number of nails clipped reaches five or more, however the clipped nails are from both hands combined or both feet combined or from both hands and feet combined, then sadaqah will be waajib for each nail that was clipped.
For example, if one clips two nails from one hand and three from the other hand or four nails from each hand and each foot (i.e. sixteen nails in total) then sadaqah will be waajib for each nail clipped (i.e. as long as one does not clip five nails from any hand or foot, one will not have to give damm).
However, if the value of all the sadaqahs combined reaches the value of a damm (sheep or goat), then he should give a little less than what is waajib so that it does not reach the value of a damm (sheep or goat).
5. If one breaks off a nail that was slightly broken, then neither damm nor sadaqah will be waajib.
And Allah Ta'ala (الله تعالى) knows best.
وليس للمحرم أن يقص أظفاره فإذا قص أظافير يد واحدة أو رجل واحدة عن غير ضرورة فعليه دم وكذلك إذا قلم أظافير يديه ورجليه في مجلس واحد يكفيه دم واحد ولو قلم ثلاثة أظافير من يد واحدة أو رجل واحدة تجب عليه الصدقة ولكل ظفر نصف صاع من حنطة إلا أن يبلغ ذلك دما فينقص ما شاء ولو قلم خمسة أظافير من يد واحدة ولم يكفر ثم قلم أظافير يده الأخرى إن كان في مجلس واحد فعليه دم، وإن كان في مجلسين فيلزمه دمان ولو قلم خمسة أظافير من يد واحدة في مجلس واحد وحلق ربع الرأس وطيب عضوا في مجلس واحد أو مجالس مختلفة فعليه بكل جنس دم على حدة ولو قلم خمسة أظافير من الأعضاء الأربعة المتفرقة تجب الصدقة لكل ظفر نصف صاع في قول أبي حنيفة وأبي يوسف رحمهما الله تعالى وكذلك لو قلم من كل عضو من الأعضاء الأربعة أربعة أظافير تجب عليه الصدقة وإن كان جملتها ستة عشر في كل ظفر نصف صاع من حنطة إلا إذا بلغت قيمة الطعام دما فينقص منه ما شاء كذا في شرح الطحاوي انكسر ظفر المحرم وتعلق فأخذه فلا شيء عليه كذا في الكافي (الفتاوى الهندية 1/244)
(أو قص أقل من خمسة أظافيره أو خمسة) إلى ستة عشر (متفرقة) من كل عضو أربعة وقد استقر أن لكل ظفر نصف صاع إلا أن يبلغ دما فينقص ما شاء (رد المحتار 2/556)
