Carrying out the Hajj-e-Badl from a place besides the hometown of the deceased

Q: Will the Hajj-e-Badl be valid if it is performed from a place other than the hometown of the deceased?

A: If the deceased made a bequest that Hajj-e-Badl be performed on his behalf from one third of his estate, then if he did not specify the place from where the Hajj-e-Badl should be carried out, the Hajj-e-Badl will be carried out from his hometown. 

If the Hajj-e-Badl is carried out from some other place, besides the hometown of the deceased, then it will have to be seen as to how far that place is from the hometown of the deceased. 

If it is within such a distance of the hometown that one can go from the hometown to that place in the morning and return by the evening (by riding an animal), then it will be regarded as being close and the Hajj-e-Badl will be valid from that place. 

If the place from which the Hajj-e-Badl is performed is further than this distance from the hometown of the deceased, then the Hajj-e-Badl will not be valid and will have to be repeated from the hometown of the deceased.

And Allah Ta'ala (الله تعالى) knows best.

(فإن فسر المال) أو المكان (فالأمر عليه) أي على ما فسره (وإلا فيحج) عنه (من بلده) قياسا لا استحسانا فليحفظ فلو أحج الوصي عنه من غيره لم يصح

قال العلامة ابن عابدين رحمه الله: (قوله فلو أحج الوصي عنه من غيره) أي من غير بلده فيما إذا وجب الإحجاج من بلده لم يصح ويضمن ويكون الحج له ويحج عن الميت ثانيا لأنه خالف إلا أن يكون ذلك المكان قريبا من بلده بحيث يبلغ إليه ويرجع إلى الوطن قبل الليل كما في اللباب والبحر (رد المحتار 2/605)
