Q: Explain the ruling of a person who delayed in performing hajj after it became fardh upon him and only set out for hajj after one or a few years, and then passed away during the journey of hajj. Does Hajj-e-Badl have to be performed on his behalf?
A: Since he delayed in setting out to perform his fardh hajj, Hajj-e-Badl will have to be performed on his behalf. However, Hajj-e-Badl will only be compulsory in the case where he made a wasiyyat (bequest) that hajj be performed from one third of his estate after his demise.
If the deceased did not make a wasiyyat, then it will not be permissible for the heirs to use the money of the estate for the Hajj-e-Badl.
However, if any of the heirs wish to do the Hajj-e-Badl from their own wealth on behalf of the deceased, then it will be permissible and it is hoped that the Hajj-e-Badl will be accepted.

من عليه الحج إذا مات قبل أدائه فإن مات عن غير وصية يأثم بلا خلاف وإن أحب الوارث أن يحج عنه حج وأرجو أن يجزئه ذلك إن شاء الله تعالى كذا ذكر أبو حنيفة رحمه الله تعالى وإن مات عن وصية لا يسقط الحج عنه وإذا حج عنه يجوز عندنا باستجماع شرائط الجواز وهي نية الحج وأن يكون الحج بمال الموصي أو بأكثره لا تطوعا وأن يكون راكبا لا ماشيا ويحج عنه من ثلث ماله سواء قيد الوصية بالثلث بأن أوصى أن يحج عنه بثلث ماله أو أطلق بأن أوصى بأن يحج عنه هكذا في البدائع (الفتاوى الهندية 1/258)
من مات بعد وجوب الحج ولم يوص به لم يلزم الوارث أن يحج عنه (غنية الناسك صـ 173)
