Iddat of a woman experiencing menopause

Q: A woman aged 53 had sex with her husband and separated on the same day, had menses after one month and still did not meet her husband. She experiences her menses after 3 to 4 months. She is going through menopause, what will be her iddat? Your reply was that if she experiences regular menses she will have to observe iddat for three menses. I understand that if she is not experiencing regular menses then she does not need to observe iddat. Am I correct?

Q: My father passed away leaving behind: 5 Daughters 2 Sons and 1 late Son (with 2 children). On the day that my father passed away, he said to my brother in law: "If I die today then the Big Shop is for my eldest son, The small shop is for my other son, And my own house is for my grandsons, The other 5 shops are one for each of my daughters." What does Shariyah Law say about the distribution of the heritance in this case? What is valid? Shariyah or Wassiyah?

Q: Is Yasir Qadhi's view of evolution valid according to scholars:

Here is a summary of what he said: Qadhi, on the other hand, accepted all of evolution except where it applies to humans. However, he conceded that the "maximum we can go" from an Islamic theological perspective is to say that God inserted Adam in the natural order. To explain his position, he used the example of dominos. He asserted that Adam was the last domino placed directly by God. From his perspective, believers would see this last domino as a miracle of God, whereas non-believers would see a causal connection from all the other dominos. This way, the miracle of Adam is preserved theologically. I read that close analysis of the quran shows that is this view is not compatible, what are thoughts on this?

Irregular bleeding

Q: A girl got her haidh this morning (Monday 8/8/16 @ abt 11-11.30 am), but her 15 days of cleanliness finished tonight at abt 10-10.30 pm. One mufti's fatwa was that she has to consider the clean-day period between the cycle of last month and the month before (which was 17 days) and only consider herself in the state of haidh once that amount of days are up, even though she's bleeding properly and even after the 15-clean-day-period is up. Another mufti said that once the 15 days are up, she's on her haidh but she has to continue reading salaah until she bleeds for 3 days and more, then she's on her haidh properly and her salaah of those days falls off. Two of her female muallimahs have mentioned that if you bleed after your 15 days you are considered as having haidh and salaah becomes haraam and sinful for you. Please inform me of the fatwa from your perspective. I am not fatwa shopping. I just need clarity on this topic as I myself get confused, which is why I look to you, respected mufti, for clarification. Second question is that she knows she became paak before 10 pm (on Sunday 24/7/16) but hadn't had the chance to make ghusl until that time so after her ghusl she read esha and made qadha of salaah. She's assuming she became paak before esha on Sunday (24/7/17) because the brown/bloody discharge stopped during the course of the day and she found out from 1 of the mentioned muallimahs that haidh had stopped, so she made qadha of those salaah. I know haidh ends soon as bleeding stops, even if one doesn't make ghusl straight away. Now, today she hadn't read esha until 9.45/50 pm & when she went to make wudhu she found blood again even though she hadn't spotted at maghrib time (but she made a fresh wudhu for all salaah) but spotted before and at zohr and asr time. Keeping all of this in mind, will esha qadha of tonight still be binding on her?

- Haiz 7 - 17th = 10 days

- thereafter on 12th clean day starting bleeding.

  Took 12th -15th as Istihaaza /clean days

JULY 2016

- after the 15 days - took 2nd - 10th as Haiz = 8 days.

- therafter 15 clean days

Current after exactly 15 clean days

Day 1 - 1 brown discharge only (asr 26 July)

Day 2 - 1 brown discharge only  (27 July)

Day 4 - very small brown noticed. (30 July)

Thereafter 7 clean days

Today 6th Aug - starting brown bleeding again. (This is the 11th day after the 15 clean days )

Please advise which days to take as Haiz and which are istihaaza.

Nikaah in the presence of two witnesses

Q: I am a divorced/single parent of one child. I have met someone in a halaal way and told that person I wanted to get married as soon as possible as I didn't want to commit zina. A few days ago we went to I think it was the Hanafi masjid and did our nikaah. The problem is I didn't as my wali which is my dad to stand up as my wali because I knew that he would want me to do nikkah in the way I wanted. So the Imman in the masjid stood as a wali for me. Now the problem is my husband looked into and phoned around to ask about this. Most of the place is saying it's invalid. Which is a big problem. So I've told my dad that I met someone and want to do nikkah but his telling me to think about it before I do it so told again I want to do nikaah as soon as possible but his telling me now he needs to think and tell me. I asked him why the need to make me wait he told me that I need to listen to him. My parents are divorced also on my mum side they do not practise Islam so I am waiting for my father now to tell me if he will be my wali or not. I really need some advice on this Insha Allah as now I'm missing the person I thought I was married to and also I live in a non Islamic house with my son. The person I want to be with is a practising Muslim and so am I. We pray five times Alhumdulilah and try our best when it comes to our Deen.

Tawaaf-e-wida

Q: Due to unavoidable circumstance, can one perform Tawaaf-e-Wida in Haj after Tawaf-e-Ziyrah during the days of Qurbani? Example on the 12th Zil Haj morning though Rami of 12th Zil Haj is to be completed.
