Q: I have a moral dilemma which I need some help and guidance with. My husband passed away a few months ago and we are in the process of distributing the inheritance within the heirs. I have a son and a daughter and his both parents are alive. There are two sums of money. One was given by the office to me and I want to distribute it among ourselves according to shariah. This was totally my husbands money. The other is our savings in which we both contributed but were in his name. My contribution included the money I got from my father as well as the savings I did when I was working. My question is do I deduct my portion from our savings before distributing it according to shariah? Or since it was no longer in my name I cannot claim it and all of the savings will be divided. One problem is that the matter is being settled by court in the form of succession certificate where it is expected that the court will keep the children's inheritance for safekeeping until they are 18. That means I will have access to only the amount that the court will give to me i.e. 1/8th. Kindly advise what should I do.
Q: I performed only nikah with a girl back in February 2016. Her elder sister is married with my elder brother. Now some problems happened between my brother and his wife and they even went to court for their personal matter solution. Her family started threatening us and told us clearly that they will not arrange to send their 2nd daughter who is my wife to our house untill we write any property or big amount on her name. We are not able to meet this demand and it was also not a part when nikah was performed. Now I have decided to divorce her immediately. But may be in future I still expect they might change their conditions. What should I do? If I divorce her, what will be the possibilities and how can I remarry her if any solution is done? Q: My husband lives abroad and spends money on his parents and siblings. He says that he can't afford my visa and tickets. Is it my right to live with him? Its been two years and I have a son. My question is, who has more right on my husbands money, his parents and siblings or me?
Q: My wife and I are experiencing marital problems. She is demanding a divorce from me. According to the legal system of the country where I reside, in the case of divorce, she has the right to claim 50% of my assets. I have not yet paid her mahr to her. She is now demanding 50% of my wealth as well as her unpaid mahr.
If she takes advantage of the legal system and takes me to court claiming 50% of my wealth, will this wealth be halaal for her according to Shariah and will I still have to give her the outstanding mahr?
