Oaths & Vows

Becoming a kaafir through breaking one's oath

Q: It is narrated from the Prophet (blessings and peace of Allah be upon him) that he said: “Whoever swears (if he does something or fails to do something) that he will follow a religion other than Islam, falsely and deliberately, then he is as he said, and if he meant what he said, he will never come back to Islam with his faith intact.” My question is if a person swears to Allah that he will never do a particular act and if he does it he will die a kafir. If he breaks his oath will he die as a kafir?

Taking an oath that every time one does a certain action one will give kaffrah

Q: If a person makes an oath that I will not do a certain act and if I do this act I will give kaffara every time I break my promise. If he breaks his oath, will he only have to give kaffarah once and his oath will be dissolved or he has to give kaffarah every time he does the act after breaking his oath?

Oath of a minor

Q: My sister took an oath regarding a specific chair "Wallahi I won't sit on the chair". A) Her intention was that she won't sit at that moment.  B) She is 12 years old and is not Baaligh.

1) Is she allowed to sit on the chair now?

2) If she sits on it will she have to pay kaffara?

Braking one's oaths

Q: I took three different oaths at once in a desperate state of mind, but then I realised it was impossible for me to fulfil them. Now that I have broken them, can I fast three continuous days for every oath. I am not poor but I don't have any money of my own (not even pocket money) and my parents are not very religious, they are not willing to help me in paying for kaffara. Please guide me according to Sunni Hanafi ruling.

Breaking an oath

Q: Does one have to keep a fast when breaking a qasam? On normal circumstances people will but does one have to fast three days for breaking a qasam if this person is in a habit of taking qasams e.g. Kasam you are going to do this and that person doesn't do what the person who takes the qasam has said. Now that the person hasn't done what the person taking the qasam said does the one who took the oath fast for three days?
