Purchasing a car on interest

Q: Person A has said that for a self employed person who has to declare his profits at the end of 1 year in the UK, it is jaaiz for him to purchase a car on interest because if he does that, he’ll be paying less tax to the government as he believes that tax is haraam.

He says this isn’t permissible for a person who isn’t self employed as such a person pays tax according to his fixed salary irrespective of where he spends his wage on. (He says that this is how the system works in UK for tax.)

What is to be said of this?

Exchanging gold for gold

Q: I had a gold chain which I traded in to the goldsmith for a new chain which he is going to make for me. The new chain might be a bit longer than my original one which I traded in, therefore, because the weight of the new chain is more, I will have to pay him a little extra money.

At the moment, my original chain is with him, and I will only take my new chain from him when it is ready. Is it permissible for us to do the transaction in this way?

Looking for faults of fellow Muslims

Q:

1. What is the meaning of: "Iman has not entered their hearts".

2. What is the meaning of: "Allah Ta’ala will search for his faults and the one who Allah takes to task, Allah will disgrace him even if he is in his home."

Sayyiduna ‘Abdullah ibn ‘Umar (radiyallahu ‘anhuma) reports: “Rasulullah (sallallahu ‘alayhi wa sallam) once ascended the pulpit and called out in a loud voice, ‘O those who have accepted Islam with their tongues while Iman has not entered their hearts! Do not cause harm to the Muslims, do not rebuke them and do not search for their faults, for verily the one who searches for his Muslim brother’s faults, Allah Ta’ala will search for his faults and the one who Allah takes to task, Allah will disgrace him even if he is in his home.'” (Sunan Tirmidhi, Hadith: 2032 and Sahih Ibn Hibban; Al Ihsan, Hadith: 5763)

Imam Tirmidhi (rahimahullah) has declared the Hadith sound (hasanun gharib) and Imam Ibn Hibban (rahimahullah) has declared the Hadith authentic (sahih).

Sub-leasing

Q: We have been running a shop for the past 8 years. We have been paying a monthly rental subject to a 10% yearly increase. However, during the last year, after the increase, we have been paying say R10 000. Due to rising costs, etc. we decided to physically split the shop in half and give it to our neighbour for R9000. We had the permission of the landlord to do this. This effectively meant that we were now paying R1000 for our portion which is quite a bargain. However, now the landlord says that what we have done is not Shari’ah compliant. We would like to know whether it is permissible or not.

Waleemah before sexual relations

Q:

1. Is it mandatory to have sex before walima? Many say walima is not halaal and first nights usually are not like what we see in movies as many factors are dependent (stress, fear, etc). Also should penis completely go into vagina and man should ejaculate or only tip is okay during first night.

2. Should a man ejaculate inside vagina whenever he has sex with his wife. During initial days of marriage couples usually are in fear and everything is
new.

3. Can couples use pullout method (before ejaculation remove penis from vagina) if not planning for pregnancy?
