Contacting the seller and offering him more

Q: I would like to know the ruling regarding a person who contacts the seller of a property knowing well that someone else is busy negotiating to buy the property. Is it permissible for the second person to approach the seller to offer him more to secure the deal?

A: If the seller is showing interest in the first person’s offer and is inclined towards selling the property to him, then it is not correct for the second person to approach the seller.

عن أبي هريرة رضي الله عنه قال نهى رسول الله صلى الله عليه وسلم أن يبيع حاضر لباد ولا تناجشوا ولا يبيع الرجل على بيع أخيه ولا يخطب على خطبة أخيه ولا تسأل المرأة طلاق أختها لتكفأ ما في إنائها (صحيح البخاري، الرقم:2140)

(ونهى رسول الله صلى الله عليه وسلم عن النجش) ... (وعن السوم على سوم غيره) قال عليه الصلاة والسلام لا يستام الرجل على سوم أخيه ولا يخطب على خطبة أخيه ولأن في ذلك إيحاشا وإضرارا وهذا إذا تراضى المتعاقدان على مبلغ ثمنا في المساومة أما إذا لم يركن أحدهما إلى الآخر فهو بيع من يزيد ولا بأس به على ما نذكره (الهداية 3/66)
