Company offering a discount to sell items to clients

Q: I’m an architect. I design residential buildings for my clients and take design consultancy in return. Yesterday, a marketing team visited me. They were selling LED lights. A single light costs $10. They offered me a discount of 20% if I recommend the lights to my clients. They also said that if I sell the light at full price to my clients, they will transfer the remaining 20% discount into my account. If I give a 10% discount to my clients, they will transfer the remaining 10% into my account. Also, it is in my authority to give a full 20% discount to my client. Is this arrangement permissible?.

A: If your clients have appointed you to purchase the lights for them, it will not be permissible for you to take this discount. However, if you are purchasing the lights and thereafter selling it to them, it will be permissible for you to take the discount from your supplier and sell the lights to your clients for the full price. If you wish to give your clients the discount or part of the discount, it will be permissible. Nevertheless, if you are an agent for the seller, it is permissible for you to receive a commission from him.

ولو وهبه خمسمائة ثم الخمسمائة الباقية لم يرجع الوكيل على الآمر إلا بالأخرى؛ لأن الأولى حط والثانية هبة (رد المحتار 5/516)

(والزيادة فيه والحط منه والزيادة في المبيع ويتعلق الاستحقاق بكله) أي يجوز للمشتري أن يزيد في الثمن ويجوز للبائع أن يحط من الثمن وأن يزيد في المبيع ويلتحق بأصل العقد ويتعلق الاستحقاق بجميع ذلك حتى لا يكون للمشتري أن يطالب بالمبيع حتى يدفع الزيادة وللبائع أن يحبسه حتى يستوفي الزيادة ويملك المشتري المطالبة بتسليم المبيع كله بتسليم ما بقي من الحط (تبيين الحقائق 4/ 83)

(والزيادة في المبيع) أي وصحت ولزم البائع دفعها بشرط قبول المشتري وتلتحق أيضا بالعقد فيصير لها حصة من الثمن حتى لو هلكت الزيادة قبل القبض تسقط حصتها من الثمن (البحر الرائق 6/ 131)
