Suburbs being joined to the city
Q: I have travelled the musaafir distance to a major city with many suburbs within it, and I will be residing in this city for two months. However, from time to time, I will move between the suburbs of this city and spend the night in the different suburbs of this city. Up to now, I do not have the intention to stay 15 days in one particular suburb. Am I a musaafir or a muqeem?
A: If each suburb is separated from the other and there is no ittisaal (continuity) between the suburbs, then you will be a musaafir. However, if there is ittisaal between the suburbs and the town (and the suburbs are linked to the town), then it will be regarded as though you are staying in one place and hence you will not be a musaafir.

من فارق بيوت موضع هو فيه من مصر أو قرية ناويا الذهاب إلى موضع بينه وبين ذلك الموضع المسافة المذكورة صار مسافرا فلا يصير قبل أن يفارق عمران ما خرج منه من الجانب الذي خرج منه حتى لو كان ثمة محلة منفصلة عن المصر وقد كانت متصلة به لا يصير مسافرا مالم يجاوزها ولو جاوز العمران من جهة خروجه وكان بحذائه محلة من الجانب الآخر يصير مسافرا إذ المعتبر جانب خروجه. وأراد بالمحلة في المسألتين ما كان عامرا أما لو كانت المحلة خرابا ليس فيها عمارة فلا يشترط مجاوزتها في المسألة الأولى ولو متصلة بالمصر كما لا يخفى.(رد المحتار 2/121)
