Price change in an item that was ordered
Q: A Muslim company confirmed the price of a product with me at R1800. They said stock will come in a few months.
A few months later, the product came and they said that I must pay R2200. I told them that they confirmed the price at R1800. The company said that price was then, and now it changed because of USD exchange rate, but previously, he confirmed R1800 and did not mention the USD exchange rate.
I waited months to buy it from them and did not inquire elsewhere because they confirmed the price and my order at R1800.
Please advise:
(1) Is their action as above permissible?
(2) If permissible, is it in conformity with Islamic values? I am annoyed because I waited to buy it from them specifically at their confirmed price. I could have bought it elsewhere all these months.
A: Since they did not have any stock at that time, no sale had taken place. Hence, they are not obligated to sell you the item for the price they mentioned when the new stock arrives.

عن حكيم بن حزام رضي الله عنه قال: يا رسول الله يأتينى الرجل فيريد منى البيع ليس عندى أفأبتاعه له من السوق فقال: لا تبع ما ليس عندك (سنن أبي داود، الرقم: 3505)
وعن عمرو بن شعيب عن أبيه عن جده قال: قال رسول الله صلى الله عليه وسلم: لا نذر لابن آدم فيما لا يملك ولا عتق فيما لا يملك ولا طلاق فيما لا يملك رواه الترمذي وزاد أبو داود ولا بيع إلا فيما يملك (مشكاة المصابيح، الرقم: 3232)
ولا بيع ما ليس مملوكا له وإن ملكه بعده إلا السلم (الفتاوى الهندية 3/3)
وأما الذي يرجع إلى المعقود عليه فأنواع ... (ومنها) أن يكون مملوكا لأن البيع تمليك فلا ينعقد فيما ليس بمملوك (بدائع الصنائع 5/146)
فنقول من حكم المبيع إذا كان منقولا أن لا يجوز بيعه قبل القبض وكل جواب عرفته في المشتري فهو الجواب في الأجرة إذا كانت الأجرة عينا وقد شرط تعجيلها لا يجوز بيعها قبل القبض (الفتاوى الهندية 3/13)
