Q: During the tawaaf of hajj or umrah, if one goes through the Hateem instead of going around the Hateem, will his tawaaf be valid?
A: In order for the tawaaf to be carried out correctly, one will have to make tawaaf seven times around the entire Ka’bah Shareef, including the area around the Hateem.
The reason is that the Hateem area was part of the Ka’bah Shareef during the time of Hazrat Ebrahim (alayhis salaam), but later on, when reconstructing the Ka’bah Shareef during the time of the Quraish, it was excluded due to insufficient funds.
Hence, if one did not perform seven rounds around the entire Ka’bah Shareef (including the area around the Hateem), his tawaaf will not be complete and damm will become compulsory upon him.
However, if he repeats the entire tawaaf or at least completes the tawaaf of the area which he left out (i.e he only goes around the hateem area seven times), the damm will fall off.
If he does not repeat the entire tawaaf or complete the tawaaf of the area which he left out and returns home, then the damm will not fall off.

ومن ترك ثلاثة أشواط من طواف الصدر فعليه الصدقة ومن طاف طواف الواجب في جوف الحجر فإن كان بمكة أعاده لأن الطواف وراء الحطيم واجب على ما قدمناه والطواف في جوف الحجر أن يدور حول الكعبة ويدخل الفرجتين اللتين بينها وبين الحطيم فإذا فعل ذلك فقد أدخل نقصا في طوافه فما دام بمكة أعاده كله ليكون مؤديا للطواف على الوجه المشروع وإن أعاد على الحجر خاصة أجزأه لأنه تلافي ما هو المتروك وهو أن يأخذ عن يمينه خارج الحجر حتى ينتهي إلى آخره ثم يدخل الحجر من الفرجة ويخرج من الجانب الآخر هكذا يفعله سبع مرات فإن رجع إلى أهله ولم يعده فعليه دم لأنه تمكن نقصان في طوافه بترك ما هو قريب من الربع ولا تجزيه الصدقة (الهداية 1/274)
وإذا طاف الطواف الواجب في الحج والعمرة في جوف الحطيم قضى ما ترك منه إن كان بمكة وإن كان رجع إلى أهله فعليه دم لأن المتروك هو الأقل فإنه إنما ترك الطواف على الحطيم فقط وقد بينا أنه لو ترك الأقل من أشواط الطواف فعليه إعادة المتروك وإن لم يعد فعليه الدم عندنا فهذا مثله ثم الأفضل عندنا أن يعيد الطواف من الأصل ليكون مراعيا للترتيب المسنون وإن أعاده على الحطيم فقط أجزأه لأنه أتى بما هو المتروك (المبسوط للسرخسي 4/46)
