Woman performing umrah thinking that her haidh ended

Q: 

1. A lady in haidh had entered into ihram, entered Makkah, then thought that her haidh was over (no bleeding for two days) so she completed the rites of Umrah. She then started bleeding again and realised that her haidh was still continuing. 

What should she do after her haidh has completed? 

Will she need to go to tan'eem and renew her ihraam as well? 

Was her coming out of ihraam valid such that using scented items etc. would not require any compensation? 

2. She performed a nafl tawaaf during that time as well (wherein she was actually still in haidh), what should she do in this case?

A: 

1. In the state of haidh, it is not permissible for a woman to enter the musjid. Hence, it is not permissible for a woman to make tawaaf of the Ka’bah Shareef in Musjidul Haraam in the state of haidh. 

However, the Fuqahaa have ruled that though it is not permissible for a woman to make tawaaf in the state of haidh, if she makes the tawaaf in the state of haidh, the tawaaf will be valid and damm will be compulsory upon her. Hence, the Umrah which she had done in the state of haidh is valid. 

The damm is to slaughter a sheep or goat (that suffices for qurbaani) in the precincts of the Haram. 

Nevertheless, if she repeats the tawaaf in the state of purity then the damm will fall off. 

She will not have to repeat the sa'ee as it is not a condition for the validity of the sa'ee that it be done in the state of purity. Hence, the sa'ee she had done in the state of haidh is valid. However, the Fuqahaa mentioned that it is preferable to repeat the sa’ee when repeating the tawaaf, though it is not compulsory to repeat the sa'ee. 

Since she thought that her haidh had ended, she will not be sinful for doing the tawaaf in the state of haidh. 

2. She should also do another tawaaf in place of the nafl tawaaf which she had performed in the state of haidh. Otherwise, she will have to give another damm for doing that tawaaf in the state of haidh. 

Through repeating the nafl tawaaf, the damm will fall off . 

Since she came out of ihraam after doing the Umrah, it was permissible for her to use scented items etc. and no damm will be required for that.
