Muslim woman marrying a non-Muslim man

Q: I am a Muslim woman married to a Christian man. We have four kids together, and for the last six years, I have been living like a Christian. However, my heart was not wholeheartedly there. My heart was always towards being a Muslim and my children too were not happy. I returned to being Muslim now but I don't know what to do. Can you please help me?

Court marriage

Q: My friend married a guy through court marriage. Why? To protect themselves from committing sins. But when they told their parents after about a month, the girls parents lashed out and said that the Nikaah is invalid. So they accepted. Now the father of the girl has placed conditions for the boy that if he accomplishes them, they will gladly have them wedded. But the parents are only doing this to kill time. What must they do? Since the boy is getting angry and wants to bring in the police. Though we all know that is not right.

Joining the family business

Q: I am from India. This academic year my graduation will be completed. I was planning for higher education. My parents want me to join in the family business. I am so helpless because higher education is my passion; without my passion I can't live comfortably. I actually mean I won't be alive. Since my parents are angry with my weird attitude they took me to a Mufti nearby. He suggests me to live up to my parents wish. I need an independent life. Is being independent a crime? What should I do?

Inheritance

Q: Kindly guide us through the following issues and questions.

• Family members are made up: 1. Father 2. Mother 3. Daughter 4. Son

Father and Mother are equal shareholders regarding a house. Both parents during their lifetime gives the son the house as a gift. Both children are informed and aware of the action. The son agrees and takes the gift (house) and also takes total responsibility to all the affairs regarding the home and regarding income and expenses of the house approximately 6 years before the father passes away. However when the gift (house) was given to the son it was given verbally so in other words there is no written proof but there are two witnesses to this action. It must also be brought to attention that when the gift was given, both children were not present at the same time but as mentioned before both children do acknowledge the action (the home as a gift to the son). The daughter however was not happy about this when both parents informed her but did not confront the son (her brother) immediately. Shortly after the father passed away the daughter started to show her disapproval and informed her mother that she does not agree to this and insists on getting her share in terms of inheritance according to the Islamic sharia.

• Does the house still stand as a gift even when it was given verbally only?

• Is the daughter’s disapproval valid and does she get any share according to the sharia?

• If the daughters claim is valid what will be her share?

Reciting a Surah in the third and fourth rakaat after Surah faatiha in the four rakaats sunnat of zuhr

Q: I just wanna ask about the sunnat-e-muakadah before fardh of zuhr. I should perform it with salaam at the end and now my question is on the third rakaat am I only going to recite fatiha and also in the forth rakaat just like praying fardh or I should recite another surah in the third rakaat and another surah in the last rakaat after faatiha?

Ghadats

Q: While I was in Johannesburg recently we were invited to a "Ghadat". I wanted to attend but my wife refused to, as she comes from a well known family of learned Scholars and they don't attend such gatherings. I, myself, have never yet attended a Ghadat. What is the purpose of such a gathering and is it allowed in the Shariah?

Doubts regarding sperm

Q: I performed my fajr salaah with jammat. After I returned home, I went to take a quick shower before going to university. Last night I can't remember if I saw any thing or ejaculating at night but in the morning while washing between my leg and private organ they was kind of a fluff dirt not on my private they was nothing there. After I smelled my underwear, there was a little smell. Don't know if it was sperm but no sign at all of any najaasat. I just changed my life a week ago after committing a few major sins. By this happening it will make me stop my ibaadat and worship of Allah. I am not sure of what to do. My bedding is not messed. I started my missed salaahs. What do I do?

Inheritance

Q: My mother died this year. She left around 16 laac rupees. According to her will she told before her death to give in charity this amount to some mosque. This amount will come under wiraasat to distribute among her son and daughters or it will go to charity according to her will. Please reply what Islamic law says about this.
