Conditions for the validity of Nikaah

Misyar marriages

Q: My question is what does the Sharia say when a Muslimah upload a video of herself telling her side of the story of being in a misyar marriage with a famous da'ee who took advantage of her? She did not explicit mentioned what exactly happened. She kept on saying that she has evidence on what occurred, but will not share them because the brother does not everyone to see and hear the conversation that took place between them. Many people are backbiting the brother. The sister said her purpose for making the video and uploading it on YouTube is to inform women who are interested to get marry to him that he had 4 wives before, but divorce took place a short while. She went on to say that he has his own view point regarding women, but she could not say what it is. She answered some people comments in the comment section that she asked scholars whether it is permissible for her to make this video, but she did not mentioned those scholars who said it is permissible to do this thing. The sister said that she and him made mistakes. But her other intention to upload this video is to expose dawah men would do behind the scenes like mistreating women since they are in a high position.

Validity of the nikaah

Q: A woman once tried to make a man fall in love with her. She said a dua, blowed into water and then gave the water to a man to drink to make him fall in love with her. She understood that she has done a wrong thing. She repented. Now whatever she has done, does it make marriage between the above man and woman prohibited?

Nikaah via text messages

Q: I have done a nikkah on message with my fiance without the presence of any witness but i took the snapshots of those messages as a proof but later after 8 months due to some misunderstandings i gave a tallaq to her later one more time i said "i end this relation right now in my full senses"(i didn't used the word tallaq second time) and later after one month due to misunderstandings i again gave tallaq 3rd time (by using the word tallaq) all these were done on messages i have snapshots of nikkah and tallaq as well and now we both are very afraid that if that nikkah was true or was acceptable according to shariah and if it is so the tallaq that i gave her was acceptable or not please help me out if both things were right then is there any way we both could be togather again and get the nikkah done or not??

Calling the groom by his step fathers name instead of his fathers name at the time of nikaah

Q: One of my friends is going to get married soon Insha Allah but we have a little query which is creating embarrassment in our minds. His actual father's name is not written under his CNIC but the name of the person his mother is married to after his father's death is written. Will Nikaah be valid as per shariah if the nikaah reciter says his step father's name as per CNIC instead of his real father's name? Kindly please clear the confusion.

Forcing a boy to get married

Q: I have an important question which I would like to ask on behalf of a friend of mine. I shall explain the whole situation and would like some Islamic advice on the matter.

Basically one my friends family have taken him to Pakistan to get married to one of his relatives there, at the time of his travel he was unaware of this. My friend likes somebody else who he would like to marry but due to his family pressure and everything he has unwillingly got engaged to his relative from Pakistan although his heart is still with the girl in UK whom he loves and wanted to wife. The girl and him have mutual feelings and still want to be together, he is not willing to forget this girl and claims he still wants to be with her, but his family have trapped him into this wedding which he is not happy with. I would just like to know on his behalf whether this marriage which was forced upon him is considered valid in Islam, because a few islamic websites I have checked on have said a marriage which is forced or not the happiness of an individual it is not valid in Islam's and Allah's eyes, is this true?

Also would it be appropriate for my friend and the girl he loves to still stay in contact regardless of this marriage which has been conducted without his happiness? What would be the best Islamic way to tackle such a situation?

Marrying a girl who committed zina

Q: Recently, I have chosen a bride for marriage. The bride told me that she had a boyfriend and her boyfriend did sex with her two times by explaining that since they both agreed to marry each other, so, they are husband and wife. The girl did not know the exact hadith and rules. She believed the boy and agreed to have sex with him. After that the girl consulted a mufti and she was informed that it was an invalid marriage. The girl stopped contact with that boy and repented to Allah. Now, can I marry her? I never did fornication. She is now very religious. I have doubts whether her towbah was correct or not and whether this marriage will be valid or not.

Homosexual feelings

Q: I am a Muslim but I suffer from homosexual feelings. As per advice from many renowned scholars, I got married. I never disclosed this to my wife before marriage. I still have homosexual feelings. So I kept having these thoughts that I have deceived my wife. So I disclosed it to her and she is ok with it as she loves me a lot and I want to stay with her too. I would like to know if this marriage is valid in the eyes of Allah since I hid this truth from her. 

Jokingly getting married

Q: When I was in school, I had been in a relationship and for fun my friends wrote a nikaah naama which included all the details like my parents' name, witnesses, lawyer, molvi (my friends pretended to be one of the characters). It even included the mahr. Then a female friend asked us separately if we accept each other as wife and husband thrice and we both said qubool hai 3 times. I had taken it as a joke and ignored it but now after several years, an aalimah I know told me that the nikkah was done at that time and I should either immediately tell my parents about this so that the nikaah would complete or ask the guy for divorce or else I would be doing a major sin. I want to confirm if I did get married or not.
