In Dars Tirmizi (vol. 1, pg. 259) — taken from Duroos Madaniyya of Moulana Husain Ahmad Madani رحمة الله عليه — it is mentioned that Ibn Abidin (al-Shami) did not regard it as mustahabb, and that the ahadith on this issue cannot be used to establish istiḥbab.
However, in Fatawa Mahmoodiyyah (vol. 8, pg. 123) the words of Ibn Abidin (al-Shami) in Radd al-Muhtar are quoted as proof that drinking fadl wudhu whilst standing or sitting is mustahabb.
My questions are:
1. According to the Hanafi madhhab, is drinking fadl wudhu mustahabb or not?
2. What is the correct position of Ibn Abidin (al-Shami) in this matter?
3. If it is mustahabb, is it specifically recommended to drink it while standing, or is sitting still better?
4. How should the apparent contradiction between Duroos Madaniyya/Dars Tirmizi and Fatawa Mahmoodiyyah be reconciled?
Q: I would like to expiate 2 oaths.
I would like to know if I give 2 peanut butter sandwiches to 10 people each, if that counts as expiation.
I used to eat 2 peanut butter sandwiches everyday as a student and also at work. I find it to be quite filling. I am a student and this is what I would occasionally or sometimes everyday feed myself. I don't eat peanut butter and bread anymore as I am on a diet.
Please let me know if 2 peanut butter sandwiches for 10 people each is sufficient to expiate one oath.
Q: Please advise on the following situation:
My wife has one sister, who is younger than her and unmarried. Their mother passed away last year. Her sister is working and currently stays alone.
My wife has asked if her sister can join us on holiday as she has no one to travel with.
Furthermore, my wife has proposed that if I do not agree to her sister joining us on holiday, she will have no option but to travel alone with her sister and our children to either Durban or Cape Town.
My wife does not feel comfortable leaving her sister alone at home, nor does she feel comfortable with her sister travelling alone.
Please advise if any of these options put forward by my wife are permissible. Are there any other options that can be considered?
Q: I have an issue on which I need Islamic guidance. I was working in a company in Karachi whose head office is in another country. According to the company’s contract, if any employee leaves the job before completing two years, then he must pay the company two months’ salary.
My intention was not to leave the company, but some individuals repeatedly placed accusations on me without any evidence or proof. They would write emails against me which created difficulties for me. Due to this mental stress and false accusations, I was forced to resign even though I did not want to.
My question is: according to Shariah, is it obligatory on me to pay this amount? Because I did not leave the job by my own will or by deceiving the company, rather I was forced to resign due to their false allegations and inappropriate behavior.
Q: I request clarification on the reason for karahat in freeing a slave on behalf of someone.
In ‘Uqood al-Jawahir, the sharh of Ashbah, an explanation is given regarding why freeing a slave for the sake of someone is considered makrooh. It explains that when one frees a slave out of honour, gratitude, or veneration for someone, it may resemble an act of worship, which is exclusive to Allah Ta‘ala, and hence makrooh or even impermissible.
Would like to know:
1. Is this explanation found in any mu‘tabar fiqh books?
2. What is the exact ruling of freeing a slave in the name or honour of someone?
3. Is there a distinction in ruling between expressing gratitude and actual intent of ibadah in such cases?

What is the status of a waqf made by a kaafir? For example, if a kafir makes waqf of land for the building of a masjid, is such a waqf valid in Shari‘ah? [Kindly clarify, and also refer to Imdadul Ahkam, where there is mention of a related fatwa regarding this mas'ala].
