Q: Zaid set out to perform Tamattu Hajj from South Africa during the months of hajj. After performing umrah, he proceeded to Madinah Munawwarah or Taa’if. When he returned to Makkah Mukarramah, he only tied the ihraam for hajj and he did not make umrah. Will his hajj be regarded as a Tamattu Hajj or will it be compulsory upon him to perform another umrah upon returning to Makkah Mukarramah for his hajj to be a Tamattu Hajj?
A: His hajj will remain a Tamattu Hajj even though he did not repeat the umrah. However, if he repeats the umrah upon returning to Makkah Mukarramah, then there is no problem in that.
Note: In this mas’alah, there is a difference of opinion between Imaam Abu Hanifah (rahimahullah) and his two students, Imaam Abu Yusuf and Imaam Muhammad (rahimahumullah).
According to Imaam Abu Hanifah (rahimahullah), if a mutamatti leaves the boundaries of the Haram and returns to his homeland and thereafter travels to Makkah Mukarramah to perform hajj, then in order for him to remain a mutamatti, he will have to repeat his umrah. If he does not repeat his umrah, he will not be a mutamatti. Rather, he will be a mufrid.
However, if he leaves the boundaries of the Haram and travels to another place besides his homeland and thereafter returns to Makkah Mukarramah to perform hajj, he will not have to repeat his umrah in order for him to remain a mutamatti.
According to the two students of Imaam Abu Hanifah (rahimahullah), Imaam Abu Yusuf and Imaam Muhammad (rahimahumullah), if a mutamatti leaves the boundaries of the Haram and returns to his homeland or he travels to any other place and thereafter returns to Makkah Mukarramah to perform hajj, then in both cases, in order for him to remain a mutamatti, he will have to repeat his umrah. If he does not repeat his umrah, he will not be regarded as a mutamatti. Rather, he will be a mufrid.
(كوفي) أي آفاقي (حل من عمرته فيها) أي الأشهر (وسكن بمكة) أي داخل المواقيت (أو بصرة) أي غير بلده (وحج) من عامه (متمتع) لبقاء سفره
قال العلامة ابن عابدين رحمه الله: قوله (لبقاء سفره) أما إذا أقام بمكة أو داخل المواقيت فلأنه ترفق بنسكين في سفر واحد في أشهر الحج وهو علامة التمتع وأما إذا أقام خارجها فذكر الطحاوي أن هذا قول الإمام وعندهما لا يكون متمتعا لأن المتمتع من كانت عمرته ميقاتية وحجته مكية وله أن حكم السفر الأول قائم ما لم يعد إلى وطنه وأثر الخلاف يظهر في لزوم الدم (رد المحتار 2/542)
التمتع (هو) لغة من المتاع والمتعة وشرعا (أن يفعل العمرة أو أكثر أشواطها في أشهر الحج) ... (ويطوف ويسعى) كما مر (ويحلق أو يقصر) إن شاء (ويقطع التلبية في أول طوافه) للعمرة وأقام بمكة حلالا (ثم يحرم للحج) في سفر واحد ... (يوم التروية وقبله أفضل، ويحج كالمفرد)...
