Hajj for a woman whose husband doesn't have sufficient money to go for hajj

Q: My husband and I would have been accredited for Hajj this year but he asked SAHUC to remove our names before the list came out as he says he cannot afford it and Hajj is not Fardh on him. 

He does own 2 cars but does not have enough disposable cash to pay for the trip. 

Is Hajj fardh on him? I can afford to pay for my own Hajj

A: The cars which one possesses and one is using enters under the necessities of life which a person is not required to sell to go for hajj. Hence, if your husband does not have sufficient wealth to fulfill the hajj, then hajj is not Fard upon him. 

If you do not have another mahram to accompany you during the journey of hajj, then it will not be compulsory upon you to go for hajj. You should perform your hajj when you have a mahram. 

However, it is compulsory for you to make a wasiyyat (bequest) that if you pass away before performing hajj, then Hajj-e-Badal should be performed on your behalf from one-third of your estate.
