Q: There is a lot of fitnah happening in Saudi Arabia; the government is allowing a lot of haraam there. The Hajj is being used by the government to extort money from Muslims. Muslims are committing a lot of haraam near the Kaaba; there are reports of men touching women's buttocks during the circumambulation of the Kaaba. Many are taking photos inside the Hajj to the point where it's almost impossible to avoid being recorded.
Would it be permissible to postpone the Fard Hajj until things improve in Saudi Arabia, thus allowing for a purer Hajj without involving haram?
A: When Hajj is fard upon a person, then it is compulsory upon him to fulfil this fard obligation. If one delays (without a valid excuse), he will be sinful in the sight of Allah Ta‘ala.
Therefore, despite whatever is happening, one should not pay attention to these things, rather one should be concerned about fulfilling the command of Allah Ta‘ala which has been placed upon him.
And Allah Ta'ala (الله تعالى) knows best.
(فرض) … (مرة) … (على الفور) في العام الأول عند الثاني وأصح الروايتين عن الإمام ومالك وأحمد فيفسق وترد شهادته بتأخيره أي سنينا لأن تأخيره صغيرة وبارتكابه مرة لا يفسق إلا بالأضرار بحر ووجهه أن الفورية ظنية لأن دليل الاحتياط ظني ولذا أجمعوا أنه لو تراخى كان أداء وإن أثم بموته قبله وقالوا لو لم يحج حتى أتلف ماله وسعه أن يستقرض ويحج ولو غير قادر على وفائه ويرجى أن لا يؤاخذه الله بذلك أي لو ناويا وفاء إذا قدر كما قيده في الظهيرية (على مسلم) … (حر مكلف) عالم بفرضيته (الدر المختار 2/455-458)
قال العلامة ابن عابدين رحمه الله: (قوله على الفور) هو الإتيان به في أول أوقات الإمكان ويقابله قول محمد إنه على التراخي وليس معناه تعين التأخير بل بمعنى عدم لزوم الفور… (قوله وإن أثم بموته قبله) أي بالإجماع كما في الزيلعي أما على قولهما فظاهر وأما على قول محمد فإنه وإن لم يأثم بالتأخير عنده لكن بشرط الأداء قبل الموت فإذا مات قبله ظهر أنه آثم قيل من السنة الأولى وقيل من الأخيرة من سنة رأى في نفسه الضعف وقيل يأثم في الجملة غير محكوم بمعين بل علمه إلى الله تعالى كما في الفتح (رد المحتار 2/457)
