Conditions for the validity of Nikaah

Nikaah in the presence of two witnesses

Q: I am a divorced/single parent of one child. I have met someone in a halaal way and told that person I wanted to get married as soon as possible as I didn't want to commit zina. A few days ago we went to I think it was the Hanafi masjid and did our nikaah. The problem is I didn't as my wali which is my dad to stand up as my wali because I knew that he would want me to do nikkah in the way I wanted. So the Imman in the masjid stood as a wali for me. Now the problem is my husband looked into and phoned around to ask about this. Most of the place is saying it's invalid. Which is a big problem. So I've told my dad that I met someone and want to do nikkah but his telling me to think about it before I do it so told again I want to do nikaah as soon as possible but his telling me now he needs to think and tell me. I asked him why the need to make me wait he told me that I need to listen to him. My parents are divorced also on my mum side they do not practise Islam so I am waiting for my father now to tell me if he will be my wali or not. I really need some advice on this Insha Allah as now I'm missing the person I thought I was married to and also I live in a non Islamic house with my son. The person I want to be with is a practising Muslim and so am I. We pray five times Alhumdulilah and try our best when it comes to our Deen.

Marriage with a person who has no religion

Q: I have a Muslim friend. She living in a non-Muslim country and married to a man who follows no religion. She doesn't know about Islam much. In that country rule they are husband and wife. How she can marry a Muslim now? Even though she is not in relationship with her husband for a long time. Please guide me in this regard. Is she in need of a divorce from that man or not?

Making a condition that the husband cannot remarry

Q: I just wanted to ask a question. I am having my nikaah done at the mosque in a week. I have researched upon the topic of allowing your husband to remarry. I wanted to have a condition in my nikaah that my husband should not remarry whilst he is married to me. If he was to do so and hide it from me he will be negligent upon his part. My query is where I live we don't have any blank space etc on the nikaah form to write such a condition. Is it enough for me to just mention it to my husband at the time of nikaah or before etc? He is already aware this is what I want as I have told him before. But online I have read on many sites that you should mention these things at the time of the nikaah otherwise it will not be valid? Please tell me how I should go about it.

Nikaah with one witness

Q: My question is about nikaah. Can a boy and girl make nikaah on their own, just oral, with one witness or without witnesses and how? We did that, we read kalima and than he asked I son of, he told his father's name and he asked do you accept me as husband. I said qubool hai 3 times, and he said the same. We had one witness. Is this nikaah valid?

Getting married after committing zina

Q: I had a question, I commited zina with a woman who is my wife. She got pregnant at the time however we did not repent at that time. The imam that married us was aware that she was pregnant but he did not make us do tobah. We got married and then we had repented for what we had done. We both were not aware at the time that you must repent or the marriage may be invalid. It has been four years since and I wish to know is our marriage valid or invalid.
