Nikaah breaking through the husband becoming murtad

Q: I was in love with a Hindu boy for the last five years. When we decided for the marriage, I asked him to accept Islam and spend some time in Tablighi jamat before marriage. He accepted Islam legally and completed all of the mandatory requirements for conversion. He also spent few days in Tablighi Jamat. Then I married him on January 23, 2015. He promised me and my family members to lead Islamic life throughout the life. After few days from the marriage he was informing me to finish all of my prayers before he reaches home and few problems started. He offered prayers on Fridays for two weeks. After 2 months from the marriage he said he doesn’t believe in prophets, Life after death etc and they are all stories. After sometime I got separated from him in the month of july 2015 as he said he doesn't believe in Islam in his own words but he was not ready to give Talaaq as he was loving me lot. Whenever I asked for Talaaq he used to say that he can’t live without me and used to refuse it. I m staying separate since August 2015. Finally, he agreed for khula in September 2016. I married to a Muslim guy within 3 days from the date of receiving my khula papers. When my family members came to know about this marriage, they are questioning me that, I didn’t spend my iddah period of 3 months and my new marriage will not be valid. I assumed that my marriage is already broken on the day when he informed me that he doesn’t believe in Islam, Prophets and life after death etc. Could you please suggest me if I need to spend iddah period now or it’s already passed? Personally I didn’t spend Iddah period as I’m a working woman. Also, please let me know if my new marriage is valid or not.

Nikaah via sms

Q: My question is my boyfriend proposed for me and I said yes to him by text. He showed it to two baaligh aaqil azaad men. Did our nikaah get valid or invalid?

Marrying an atheist

Q: I got a proposal from my aunty (she lives in America) for her step-son. But the problem is he does not follow Islam. He is an atheist. He does not believe in any religion. My parents and my aunt are telling me that if Allah wills, he will accept Islam in the future (after marriage). My question is can I marry him, is it halaal?

Witness not hearing the nikaah

Q: I performed nikaah few days back but after some days the witness told my husband that he didn't listen to the nikaah ceremony properly and didn't listen when I said "yes" for the nikaah. He said that during nikaah his mind was deviated from the ceremony and in short he didn't listen to our nikaah and my acceptance. He then advised my husband that he should perform nikaah with me again. So I just want to say that was that nikaah valid or not because the witness denied that he listened to the nikaah.

Nikaah in the presence of two witnesses

Q: I am a divorced/single parent of one child. I have met someone in a halaal way and told that person I wanted to get married as soon as possible as I didn't want to commit zina. A few days ago we went to I think it was the Hanafi masjid and did our nikaah. The problem is I didn't as my wali which is my dad to stand up as my wali because I knew that he would want me to do nikkah in the way I wanted. So the Imman in the masjid stood as a wali for me. Now the problem is my husband looked into and phoned around to ask about this. Most of the place is saying it's invalid. Which is a big problem. So I've told my dad that I met someone and want to do nikkah but his telling me to think about it before I do it so told again I want to do nikaah as soon as possible but his telling me now he needs to think and tell me. I asked him why the need to make me wait he told me that I need to listen to him. My parents are divorced also on my mum side they do not practise Islam so I am waiting for my father now to tell me if he will be my wali or not. I really need some advice on this Insha Allah as now I'm missing the person I thought I was married to and also I live in a non Islamic house with my son. The person I want to be with is a practising Muslim and so am I. We pray five times Alhumdulilah and try our best when it comes to our Deen.
