Suing for medical negligence

Q: Alhamdulillah, approximately 5 years ago Allah Ta'ala had blessed us with a baby girl. She was born prematurely and was jaundiced together with her blood type being incompatible with her mother. The doctor discharged her from hospital after keeping her for a night. After a few days at home her condition deteriorated to such an extent that when she was eventually rushed back to hospital the jaundice had already severely damaged her brain. As a result, she is now diagnosed with cerebral palsy and is handicapped to the extent that she is completely dependent on us for everything. She is unable to sit, talk, crawl, walk, eat or do anything else by herself and requires full-time care giving. 

There is currently a group of lawyers who have heard about this case and after having shared the details of what had transpired with them, they strongly believe that this is a case of medical negligence and are prepared to take on this case at no charge. 

Is it permissible for us to pursue this case and if it is then established in court that this was due to medical negligence, will it be permissible to sue the doctors for the medical costs involved thus far and those which may ensue in future as well in terms of specialized equipment, therapies, care giving, medical supplies, etc. which runs into tens of thousands of rands?

Using a continuous glucose monitor

Q: I am, as per blood results and my doctor, on the brink of Type 2 diabetes. One of the options to try and reverse this is to use a continuous glucose monitor. What is the position with this in terms of ghusl? 

The patch is kept on for 14 days at a time and then changed. Please advise what is the position in terms of ghusl as if we are required to remove this in ghusl then it cannot work as each patch costs almost R1500 per 2 weeks.

PRP (platelet-rich plasma) treatment

Q: I wanted to ask about PRP treatment and this is how it works: 

A sample of the patient's blood is drawn. The blood is then processed in a centrifuge to separate the platelets from other blood components. The concentrated platelet-rich plasma is then injected into the area needing treatment. The injected PRP stimulates the body's natural healing process by releasing growth factors and other proteins that promote tissue regeneration, collagen production, and inflammation reduction. 

Is this allowed? Because I have acne scars... and I don't know if its allowed or not. 

Aafiyah Healing, Bodytalk & Reiki

Q: With regards to the permissibility of using Aafiyah Healing, Bodytalk & Reiki as alternate healing/treatment, the treatment which is of great concern is one which is carried out by a practitioner abroad. 

All she requires are names of patients, other family members and maybe a few other details. 

There are no one on one consultations, to the extent she can tell things about patients and their problems even whilst the patient is asleep.

PRP (platelet rich plasma) treatment for hair growth

Q: There is currently a hair growth treatment that is being offered for people who suffer from serious hair loss. 

In the treatment, blood cells are taken from a person with healthy hair (not your blood cells but from someone else). These cells are then genetically modified in a lab and mixed with a serum which is applied onto your head. They then do micro needling which allows the serum to get into your scalp. 

During the process of the treatment, you are also required to use a minoxidil spray every night. 

Is the above treatment permissible to use?

Female going to a male naturopath

Q: I am a female and went to a male naturopath and he checked my pulse which I thought he won't and felt really bad about it as a ghair mahram touched me. But now I really need treatment and haven't heard of a female naturopath. Is it okay for me to go to the male and is it fine if he touches my hand to check my pulse?

Taking advice from a hakeem or physician when using treatments prescribed in the Hadith

Q: Are treatments of various diseases mentioned in hadiths part of wahi? Should we do them or go to a hakeem who has expertise in this field? The Hakeem tells other procedures with the same thing like in hadith cure for pneumonia is mentioned with qustul hind and hakeem also tells a procedure with qustul hind but a different method not the same method told by the prophet.
