Talaaq

Q: Due to a conflict between my in-laws and me, I left my wife at her parents home with the condition to solve this prolonged issue within 10 (ten) days. I said to her to tell her parents that if this issue is not sorted out by her parents withen 10 days then you (she) must stay at your (her) parents home. I will not be responsible for you and your future. After this period all efforts from your parents side will be useless. They did not contact me at that time, and now they approached me after three months. Can we continue our marital life now or is the separation done?

Q: My wife is seeking khula/divorce on the ground of alleged "irrevocable differences". I agree (reluctantly) provided she reimburses my mahr as well as other items of wedding and walima dresses and suites and other items of jewelleries. I have been waiting for the past six months but her (parents) have been non cooperative and belligerent in a sense, NO RESPONSE at all.

Initially they went to Islamic Sharia Council in London, UK and petitioned for divorce which I contested on the grounds that the cause of marriage was her (fraud on the grounds of illicit friendship outside our marriage) entirely her own fault. After a couple of months they decided to withdraw her petition from Islamic Sharia Council. She has now enlisted the help from Birmingham Central Mosque citing the same false accusations and demanding divorce. I will strongly contest on the same grounds. I will give her khula on condition that meets my certain conditions like the return of my mahr, my jewelleries and expensive items of clothing’s. From Islamic Sharia prospective am I right in my demand of my goods?

In a nutshell she wants a divorce from me because I CAUGHT HER RED HANDED with a "family friend" (not even a family friend but just a friend. She is not prepared to break up their friendhip for the sake of our marriage). Please advise me on where I stand.

Q: I have been married for 27 years. My husband used to beat me but now his health doesn't allow so he calls names. Recently he crossed the line by saying that our nikaah is haraam and as a result our children are haraam. I am very upset and troubled. He prays 5 times a day and even wakes up for tahajjud. He has read the tafseer and been for hajj and umrah.

Q: I have been seperated from my husband for 3 years now. We had no contact at all and he has not paid any money to financially support me. I would like to know if my talaq happens automatically?

Q: Out of fear for a court case, the husband wrote in a letter to a lawyer that he and his wife are in the middle/process of separation, in the Dutch languauge. Does this count as 1 talaq or not even 1 at all? He saw this letter that he had once wrote while he was goimng through his emails. He defintly had NO intention to do so and even did not remember he had written this letter until a few days ago. Will this be 1 talaq or no talaq at all, since there was absolutely no intention and saw he wrote this letter almost 8 years ago. Now they are a very happy couple with three kids alhamdulilah. 

Q: I want khula from my husband. I have a child and my husband wants that child. What should I do in this case?

Q: I am a mother of 4 and have communicated with a Moulana that I would like my Talaq due to a toxic and unhealthy relationship. He refuses to give me talaq and I am now considering leaving. If I leave, how long does it take for an automatic talaq to be finalised and if not how may I, as a woman, go about giving him the talaq.

Q: I was recently married and have asked my husband for talaq because he is not providing for me and since I told him I'm pregnant he has not supported me or the baby, he is not with me cause he chose to walk out on us, he cannot provide a home or anything neither has he done anything as far as the pregnancy goes, I am doing this on my own but with support from my family. He did give me talaq but via watsapp, so I would like to know if the talaq is valid?

Q:

1. If a woman applies for fasakh, what is the duration until the marriage will be disssolved?

2. Does she have to sit in iddat?

Q: I took a second wife while I was still married to my first wife because my first wife had an issue called vaginism as she cant have sexual intercourse. After 2 months my 2nd wife started to behave wiered as she seems to be going through some psycological issue in her life. She tried to commit suicide more than 5 times while she was with me. Now she is asking for 5 million for me to give her divorce. I dont have that much of money to give her. I was paying almost 3 year close to 1000 usd every month just for her and the son she got from her ex husbond. She was kicked out from her parents home. Now she is troubling me asking me for this large sum of money for divorce. Am I allowed to take money as a loan from the bank to pay her and release her from my life to live a peaceful life
