Conditions for the validity of Nikaah

Girl not accepting the nikaah

Q: A friend of mine was forcibly married to her cousin. She never accepted the marriage and clearly said no to marriage at the time of Nikah. She kept asking for divorce and her husband would say OK. In one conversation she told him, she would not come to him and does not want to keep the relationship of marriage. He said OK and replied, he would not come to her either. It's been 20 years since and they have no marital relations. They do not live together. It's the nikah/marriage still valid our broken ? She has not received any mahr after marriage and she doesn't want anything from him.

Marrying a new Muslim girl without the consent of her parents

Q: I am a muslim guy and I want to marry a girl. She is also a born muslim but her father is not muslim and her mother is also a muslim. So I want to marry her but we dont want to tell her parents about the nikah and will tell them later. Please advise me. Should i marry her withot her parents consent? Is it right and after nikah we have decided that the girl will live with their parents until we tell them about our nikaah.

Misyaar nikaah

Q: Is the following type of marriage permissible: A Misyar marriage can be defined as an official marriage contract between a man and a woman, with the condition that the spouses give up one, two or several of their rights by their own free will. These include: living together, equal division of nights between wives in cases of polygamy, the wife’s right to housing (sukna) and financial support (nafaqa).

Arranging the nikaah on the phone

Q: I recently did my Nikkah over the phone. My husband lives 100 miles away from me. He was at the Masjid with his two witnesses plus the Imam and I was at home. The Imam called me, asked me questions regarding to the Marriage also asked my wali which was my 16 year old son if he excepted this Marriage which of corse he agreed. Please can you tell me if my nikaah is valid?

Reuniting after a faskh

Q: My question is twofold: 1) Can I retain my wife in a marriage wherein she claims that I have not been emotionally supportive of her and she is unhappy, yet I feel I want to work on the issues (especially since we have 3 children to consider)? 2) We have already divorced twice (2 talaqs) and knowing that after the 3rd talaq we cannot reconcile without first marrying other people - what if she had to pursue a Fasakh (annulment) which is then granted, can we perhaps still re-marry after that?
