Talaaq

Husband writing to the wife "I DIV you"

Q: In May 2014 I was issued with my first divorce (but my husband wrote I DIV you). I was not present in the same room when he wrote it. Then around the end of May he issued the 2nd one same thing he wrote I DIV you, I was in his presence when he wrote it. Then end of July 2 days after eid he issued the last 1 also I DIV you. I was not present when he wrote it. I then started to sit my Iddat, we did have intercourse twice during my iddat period, but never got back together. I want to know now am I divorced was all 3 valid?

Divorce under duress

Q: If a man is being forced by gun to give 3 talaqs, I have understood from your fatwas that the talaqs will take place even though he was forced. But may the man instead act on the Shafie opinion that talaqs do not take place? Since otherwise his life will be destroyed - his wife will be haram on him, his children will grow up with divorced parents, his wife will have difficulty supporting herself etc. I know that we should generally not act on views of another madhabs, but may the man make an exception is this case (even though he would be Hanafi) since this is such a delicate situation which will affect his whole life?

Writing "I will give you talaaq"

Q: I would like to know if talaaq given via sms is valid because I was very angry and upset and in so much of doubt and confused and I was influenced by my friend to do it and he told me to just do what he says. So being in that state of mind I was not thinking properly so I wrote "I will give you talaaq (islamic divorce) and sent it and after 2 days later he said must do the same send another sms and again 2 days later another. He didn't explain about talaaq to me and about the iddat period and the time to reconcile between each period. I got different answers because people say sms is not valid and if influenced by someone to do it then it is not valid. So I would appreciate if you could shed some light on this topic. We want to reconcile and work things out but not sure where we stand because there is a lot going on.

Suspending talaaq upon speaking a lie

Q: I signed a single talaaq paper but did not inform my wife. Before signing, a few days before, I told my wife not to tell a lie and if she lies from now on, talaaq will happen and she lied again. I did not send the single talaaq notice to her as the address was incorrect on the deed, later while making a correction in the divorce deed we mentioned "triple talaaq" and again I signed this deed and sent the notice to her. All this happened within a month and she was at her parents house, we also had marital relations while she stayed with me in my house. I want to know how many talaaqs happened? If the total count is two (by considering triple talaaq as one) what do I do to take her back as my wife. Today is her 90th day of iddah.

Talaaq-e-baain

Q: My husband and I fight a lot where he threatens to send me back to my parents home. Recently while fighting he said he doesn't want me anymore and he's tired of me. So after much arguing, I asked him if we married, yes or no. His answer was no. Does this go as a talaaq?

Husband telling the wife "It's over"

Q: On the 9th of December my husband told me its over over whatsapp but after that we slept together and told me he didn't mean what he said and then again he told me "I'm done" and again over whatsapp that was on the 3rd of January and then my mum asked him are you and my daughter finished now, so he said yes. Does this mean we are divorced or not?

Husband telling the wife "tala"

Q: I wish to mention that +-10 years ago my wife and myself had an argument  and during that argument she claims that I had verbally mentioned talaq 3 times to her. I did not mention that but said, tala tala tila. Both of us engaged with her family regarding this matter. They accepted and said we can carry on living together. During that time we had a baby girl who is currently 7 years of age, and my eldest then who is now 15. We worked together in building our family, invested in property and together furnished a new home. We also travelled abroad and shared family vacations together. Only until recently due to our current issues the talaaq matter came up for no reason. Kindly revert with feedback if the marriage is valid or not?
