Talaaq

Husband telling the wife to leave

Q: I am a 20 year old girl. I got married last year December. Recently my husband and I have been having some problems. He has told me to leave twice but from those two times I only left once which was last week Wednesday. I am currently at my father's house. My question is if my husband told me to leave, does that count as a talaaq?

Husband telling the wife "then stay here for good"

Q: I was at my parents home for a meal function and there where guests there. My husband started swearing at me and said I must come home with him immediately. I said I will come after the function is over, as it is rude to just leave abruptly for no reason. On 3 occasions he told me 'come now or don't come/if you don't come now then stay here for good'. What does this mean? He does lie often, so if I ask him if it meant talaq he can lie and say no even if he did mean it at that time.

Court issuing khula'

Q: I filed for khullah in court on Feb 2014 and got khula' in my favour in June 2014 because my husband didn't show up in court neither he contacted me and my family, as he always said I'll never divorce you and neither will keep you as my wife. While I was in iddat (I planned to get a fatwa on my khula from muftiyaan when I got my certificate from court. The court remained closed in August. I got written divorce from my husband today almost three month after the court granted me khul'a and on the 17 th month of our separation. Kindly guide me about my iddat period as the court iddat will be finished on the  10th  of September. What should I do now as Sunnah. Please advise me. He didn't even bother to give me nafqa since our nikaah and didn't pay my maher as well.

Ambiguous words of talaaq

Q: I have read all the questions and answers on this website relating to talaak and Fasakh and the common factor is Intention. My question is, the husband must have intention when pronouncing divorce. What if the husband and wife constantly argue and the husband always tells the wife “I want you out of this house” “leave and never come pack” “I’m taking you back to your parents” "don't come back to this house". Can this be understood as a talaaq? How many times must/can a wife be told these words? Or should she just ignore them simply because the husband did not intend to pronounce divorce?

Custody of children after divorce

Q: I am a divorced woman with two minor children. I had been through a difficult marriage wherein I was physically, verbally and mentally abused. Presently my children are with me. My ex-husband and his parents are demanding that I send my children to spend the day with them or allow them to take them for a drive or shopping etc. Due to my history I`m not happy with this. They claim that I am depriving them of their Islamic rights. Can Mufti saheb please advise us with the shar`i ruling in this matter?
