Talaaq

Q: My husband send me divorce on sms. He give me divorce not in front of me. He just write I divorce you three times and send to my cell phone number by sms. Is divorce valid?

Q: After a man gave 2 talaaqs to his wife and in her iddat time they never reconciled and now few years later he gets married. Can this first wife come and say she wants to get married to him again because the 3rd talaaq was not given?

Q: My husband texted me that he is giving me the authority to make khula..and he also told me that I am free to fly ..when I asked him if he meant divorce by it..he said he meant i am free to choose between staying or leaving.. has the divorce taken place?

Q: I have been married for almost 10 years. I have 2 wonderful boys. My husband was a recovering addict when we got married, with my 1st pregnancy he relapsed and since then it's been rehab in and out. He has been in and out of work also. Recently he was detained, I have however helped him through all this because I love him. I'm so tired of this uneasy marriage as happiness only last for so long. His addiction is affecting the kids especially my eldest of 9yrs old... Is it wrong of me to want to walk away from this marriage? He keeps on promising that it's the last but then he ends up disappearing for days and I'm not even sure if he has someone else in his life. He disappeared again on Saturday evening and this time around took my wedding bans probably to sell it.

Can I asked for Faskh? I have tried to hold on to this marriage but I cannot endure all this hardship, sleepless nights and stress. I'm emotionally drained.

Q: We are a married couple of 28 years Alhamdullillah. We found ourself in a situation where someone did black magic to enter our bed and so far hurting my husband till I submit to him. It came to our attention that the spell can be broken through talaq. We hav no intention of talaq but for safety reasons. Once the spell is broken, will we be able to resume our marriage under this circumstance? 

Q: There was a heated conversation between my brother and his wife in which she was asking him “are we divorced”. He was saying yes at the time not intentionally answering her question. He didn’t give her divorce or nothing. It didn’t even come out of his lips. What is the ruling?

Q: One time me and my wife were arguing because she kept accusing me of loving another woman which was not true so I got angry and said "here's your house keys and your car keys bye bye". I was angry and I left the house. I wanted to go to my family's house but after walking about 10 minutes I said to myself "why are you going to your family's house just go back home" then I walked back to my wife's house and we said sorry to each other. Is this divorce because I didn't know what was my intention at that time but I didn't want to say talaaq. So I think I was just angry but I am having waswas thinking what was my intention at that time when I said these words. I think I was only upset with her accusations and wanted her to stop. 

Q: I am a female who is legally divorced in USA for more than one year. My ex husband went to a Shariah board 3 times during this divorce but refused to give me an Islamic divorce. During the marriage, he refused sex and any kind of relationship with me. He has not touched me for more than ten years. Am I still under his nikkah?

Q: Me and my wife love each other, but due to some misunderstanding 3 talaq occurred between us. We did not know about three talaqs but I uttered 7 to 8 times the word talaq to her. So people said that it is 3 talaqs. We do not want to separate and we do not want to break the laws of Allah so we were told about Halalah. Some friends suggested this to us. Since one person is impotent eunuch and has sympathy for us, he would like to help us if Shariah permits.
