Doing saee before tawaaf-e-ziyaarah without ihraam

Q: My wife and I went for hajj alhamdulilah. We completed our umrah and waited for the hajj days. The morning of the hajj day, very early, because my wife was pregnant and it was the 8 month of her pregnancy so after advise from prominent ulama they suggested I do the saee for the tawaaf e ziyaraah before the hajj starts. So the morning my wife and I did a nafl tawaaf and with the intention of saee for my wife I joined her to do the saee. In this way we completed the saee and then joined up Ml Olgaa to to do our hajj. 

After 5 days of hajj we stayed one extra day in Mina. The next day we came to Makkah and did our tawaaf ziyaraah and my wife did not do the saee as we, according to the advise, she did it before the hajj days, actually the morning before the hajj started. Please advise if this is correct.

Repaying for an in incorrectly refunded item

Q: I bought 3 Ryse supplements from TikTok shop 2 years ago but I claimed that they never showed up even though they did and I received a refund. What can I do for forgiveness and to use this product? Is it even possible to use the product? 

I contacted TikTok customer service and they said they usually cover the cost so TikTok is the ones that lost money. I told the customer service individual that I received the order but still asked for a refund and they said that I can’t pay for it now. If I can't use them do I give them away as they are protein supplements.

Boundaries of an area to calculate safr distance

Q: I have a few questions about safr. 

1. What's the boundaries of Durban? Like a person leaving Overport, when will he start counting? And when returning if he stops in Pinetown, will he read qasr? And what about if he stops in Sherwood? 

2. In each direction where will he read qasr? So if he is going north up the coast where will he be able to read qasr? Going south on the n2? And going north on the N3? 

Basically what's the boundaries of Durban.

Making a bequest for an heir

Q: A lady has a property that she earns rental from. She has stated verbally that upon her demise, this property must go to her 3 sisters. If she passes away, her heirs will be her 3 daughters, her husband and her 3 sisters. 

1. Is this bequest valid and binding? 

2. Will the ruling be different if her father is alive at the time of her demise?

Gifting a portion of one's share in properties to one's daughters

Q: Please assist with query below: 

Ismail and Ishaaq are partners in purchasing properties. They have 10 properties that are owned jointly by their company. Both of them own a 50% share. Ishaaq wants to give his two daughters a 25% share each of his 50% share (which is effectively 12.5 % of the entire company to each daughter). 

1. Will Ishaaq need Ismail's permission to do this? 

2. Will an ordinary offer and acceptance of this gifting be valid? Considering it is spread over few properties and jointly owned, how can he otherwise pass on ownership? 

3. If he sells the share to them at a minimal price instead of gifting it, will it be valid e.g. the share is worth R1 million, and he sells it to them for R1000, will this be valid?

Studying Darwin’s theory knowing that it is false

Q: If a scholar gives a very strict fatwa regarding something related to shirk, but all the other trustworthy and reputable scholars give a more balanced and moderate fatwa, then if I follow the opinion of the scholars who gave the balanced fatwa, will I become a disbeliever or sinner? 

For example, when studying Darwin’s theory—if someone studies it while keeping in mind that it is false, and only continues studying it for academic purposes, and this opinion is supported by many scholars—But one scholar says that such studies are "trash" and that there’s no need to study them as it could harm one’s faith. 

In that case, if I follow the balanced fatwa and not the harsh one, will I be considered a disbeliever or a sinner?

Body corporate allocating insurance for the home in monthly levies

Q: I have recently moved into a house which forms part of complex and is run by a body corporate. The house belongs to my wife in a Family Trust, however I pay the expenses to run the house. I have just recently found out that the monthly levies I pay includes a portion which is allocated to insurance for the home. I was unaware of this and thought that the home was uninsured. 

Please advise on what I should do ?

Performing qadha salaah in the masjid

Q: I have heard that one should pray Qadha prayer in solitude so that it should not be revealed to anyone that one is praying Qadha prayer. Is this true? 

If so, then there is a problem that in a house where one does not get solitude and it is not possible in the mosque, then what should one do in such a case? 

Then can one pray Qadha prayer in front of the family members or in front of everyone in the mosque.

Missing Jumuah Salaah

Q: If a male misses 3 jumuahs through work purposes but he had clarified it with his boss but had no one else to put in his place, what should he do concerning reading the shahaadat? The boss has promised that he will be getting a replacement.
