Novated Lease

Q: I am writing to seek you advice in relation to procuring a motor vehicle using a leasing arrangement. Which (if any) of the following options are a halaal option of buying a motor vehicle through a salary packaging arrangement?

Novated Lease

Finance Lease

Hire Purchase

Chattel Mortgage

In particular, I wish to know if Novated Leasing is Halal? While you may already be aware on how Novated leasing work, however I ahven taken the liberty of copying and pasting an explanation from the internet for your consideration (which is exactly how it works in my current place of employment);

Novated Lease Explained:

"A novated lease is a three-way agreement between an employer, employee and a financier whereby an employer leases a car on behalf of the employee. A car is leased in your name and running costs such as fuel, insurance and maintenance are all included in a single lease repayment, paid for using a combination of your pre and post-tax salary. This means you could reduce your taxable income and pay less tax"

If none of the above are halal, please advise of an alternate halaal finance option applicable in the West. I look forward to your guidance in this matter.

Claiming for more than the actual damage

Q: I have recently bought a house through Islamic Financing. The bathroom tiles fell down about a week after we moved into the house. The seller agreed to fix few thing before closing the deal but after closing the deal, the seller refuses to fix anything. I spoke to an attorney and the attorney tried to do a settlement with the seller but he ignored us. My attorney gave me an option to file a lawsuit against the seller. My question is, if I file a lawsuit and get a compensation more than the actual cost of the damages, will that be halaal for me to keep?

Doctor prescribing the morning after pill

Q: As a Muslim doctor working in the emergency department, I frequently come across women requesting the morning after pill. I refuse to prescribe the morning after pill on religious and moral grounds. In that case, another doctor prescribes it. The morning after pill prevents a fertilized egg from attaching to the uterus. It has the potential to become a human. Is it okay to prescribe it if it is based on need, weakness or illness?

Buying and selling shares

Q: Is it permissible to do share marketing. For example, I bought 100 shares of Reliance Communication for 35 Indian rupees per share. Suddenly the share value increased to 38 Indian rupees. So I sell the 100 shares on the same day and got a profit 300 Indian rupees. Is this halaal or not?

Mandatory car insurance

Q: I live in a country where car insurance is mandatory, without which one cannot drive and get anywhere. Out of necessity we got a car insurance.

Recently, my mother got in a car accident (it was not her fault, she was hit from behind) and was injured (she has a concussion and pain in her head). Per the insurance rules, she was to be given treatments (physiotherapy and so on) as well as compensation money due to her injury. The insurance company did not give her the compensation money or pay for her treatment costs completely. She wasn't event told she could receive compensation.

Later, she talked to a lawyer who was introduced by her friend who told her about it. Now she is making a claim against the insurance company to receive proper treatments (with all costs covered) as well as compensation money.

Is this compensation money halal to use?
